NEW YORK - Joseph Lozito, the Philadelphia man who subdued a serial stabber on a New York subway, is now suing the city of New York and its police for damages.

Lozito's attorney claims that new evidence shows two police officers on the subway train locked a door when they saw stabbing suspect Maksin Gelman approach Lozito, rather than rendering aid.

Gelman stabbed Lozito multiple times before Lozito and the officers subdued Gelman.

Lozito's attorney also claims Lozito almost bled to death in the subway car before police provided assistance.

I wish the man the best of luck ... I just don't see him winning the case.

Let's keep track. Of course, it's always good to have the system on record that police are not there to protect you.

Lol what a bunch of gutless cowards. What the fuck are they there for if not to stop a crazy man stabbing people? I mean, we all know the answer, but the general society doesn't...

Yeah there has already been surpreme court cases where they make the claim the police have no obligation to help you whatsoever. Good luck to this guy, but the system just wants your money, not the responsibility.

Yeah there has already been surpreme court cases where they make the claim the police have no obligation to help you whatsoever. Good luck to this guy, but the system just wants your money, not the responsibility.

Well, the case I know about, Deshaney v. Winnebago County Social Services, involves the state knowingly allowing a child to remain with an abusive father. The decision clearly absolves the state of any wrongdoing, and if it's upheld, then this guy is SOL.

However, the dissent for Deshaney is very pointed. The dissenting argument is basically this: look, if you're going to deprive people of the means to do something about it outside state intervention, then you're going to have to hold the state accountable when it fails to intervene.
And this guy had no legal way to even the odds.
I hate to agree with the likes of William Brennan, but that's some pretty sound reasoning.

Unfortunately, legally it's all crap. Even if this guy's case goes to SCOTUS, what are the odds with the current makeup that they'd reverse course and go with the thoughts of one of SCOTUS' most infamous progressives?

How could such sound reasoning not sway a majority? This is the Great Fallacy right here. Regulation without Accountability is Tyranny!

When the court tosses the case out or he otherwise loses, it should be made very public as to the reasons, especially if the court says that police are not obliged to render assistance. Expose the sham for what it is.
