Having sent the draft through Fiscal Research, it has been established that we would lose zero dollars in Federal Highway monies for passing this bill. This bill is a critical step for civil libertarians, and would help to reaffirm the 4th and 5th Amendment protections ensured by the US Constitution. It’s time to stop torturing the definition of probable cause and get back to the free society that American and North Carolina is supposed to be.

Oh I don't know, this one ought to pick up more Dem support than Rep, IF we pick up all 52 Democrats (not likely) we'll need 8 more Republicans (plus myself) to make a majority.

Thanks guys -- over the course of the next 2 sessions if we can increase the Constitutionalist composition of the NC House, a lot more of these bills will actually pass. ;)

This is awesome. What can we do to help get this passed?

Warrantless checkpoints and roadblocks are already "unlawful", no?

I'm assuming this bill would make them "illegal".

Good work, Gunny! Get this done before June, I may be making a short drive into NC so I can 'X' another state off the list...

Find all your friemds who live in NC and tell them to contact their reps to support the bill ;) We'll find out Thursday what committee it gets sent to. Probably Judiciary B... and thanks!

I think it's vice-versa, they are already illegal per the US and NC Constitutiona, but they are currently supported by NC General Statute making them 'lawful.' This bill deletes most of the statute in question and adds further restrictions, making them 'unlawful.'

But in any case, I'm not the one that came up with that particular language. I just said "banned in North Carolina." I let the experts adjust the language on this one. :)

Wow, Glen. That's what I call responsive! Did my post have anything to do with it or was this already in the works?

Bump

Glen, check out the thread I posted and linked above. GS20-29 appears to give police carte blanche for "license checks" so you should probably incorporate a change to that statute into this bill too. The bill this thread is based on applies to GS20-16.3A. Doesn't make sense to address this section while leaving 20-29 wide open. That would give the state a defense if brought up on a civil rights lawsuit.
