Justice Clarence Thomas dissented, joined by Justices Anthony Kennedy and Samuel Alito.

Thomas said the majority ruling would add to more prisoner appeals and delayed justice. "What prisoner would not avail himself of this additional bite at the apple?" he wrote.


Screw you Thomas. I for one would rather some more delayed justice than risk killing an innnocent man.

Yeah. I disagree with Thomas on this one, but he's still my favorite Justice. He's the only justice who really has a literal interpretation of the commerce clause.

This was a state issue, he was convicted in Texas court; so why a Fed Civil Right Suit?
