In a complaint filed Monday morning in the U.S. District Court for Minnesota, Ventura is suing the U.S. Department of Homeland Security (DHS) and its secretary, Janet Napolitano, as well as the Transportation Security Administration (TSA), and its administrator, John Pistole.

Ventura accuses the agencies of violating his "basic rights to privacy and dignity, and his right to be free from unreasonable searches and seizures," after he received a pat-down by a TSA agent at the Minneapolis-St. Paul International Airport in November 2010.

In 2001, in the days after the September 11th terrorist attacks, then-Governor Ventura said increased scrutiny would be acceptable.

"We're at war and we're at war inside our own country," Ventura said on Sept. 27, 2001, "something we've never seen or heard of before inside the United States of America. I don't think you can be too careful and people are just going to have to accept a little bit of inconvenience."

I felt the same way. A lot of people did. But then a few months later I started thinking just how "inconvenient" life could get if the solution to every obvious terrorist threat was more government. I began to think "Would any terrorist worth his salt try the same boxcutter trick again, or would he do something like......" Once I thought that through I realized the security state was the wrong answer. Then I began rethinking the question and began looking into 9/11 itself. My first question was "Could the government have stopped this without violating the constitution"? The answer to that question is a resounding yes!* I kept looking further down the rabbit hole. It gets very ugly very fast.

*("Blowback" arguments don't go far enough People don't just want to "not make the bad guys angry". We want and deserve protection from our government that does not involve violating the constitution. For instance we had Moussoui in custody. The justice department was wrong to block Coleen Rowley from even filing for a FISA warrant. Someone in the Bush justice department should be in prison for criminal negligence at least.)

I assume you're being sarcastic. But just in case you aren't, it's impossible to question the government theory on 9/11 as Jesse Ventura has for several years now and still believe that we should trust the government to keep us safe. After all if the government let 9/11 happen or purpose or caused 9/11 or if it had all of the intel it needed to stop 9/11 but didn't because of its "incompetence" then why trust that same government with more of our freedoms? And for the record Jesse Ventura had started speaking out against the growing police state in the U.S. before he switched on 9/11 truth. At times he'd be on the Alex Jones show talking about how bad America was getting, but he still remained hostile to the 9/11 truth movement. You think he's doing this for the ratings? To quote the governor "Think again".

Thanks for posting this! Here are a couple of things to consider.

1) As a business traveler Ventura has both standing and can prove damages. Both are important for winning a lawsuit. Simply saying "Well you don't have to fly" is impractical if your job description requires you to go to different parts of the world.

2) Once again someone is raising the "Little bit of inconvenience" quote. But that doesn't apply here. Being sexually groped is not a "little bit of inconvenience". And Ventura's mindset with regards to terrorism has evolved quite a bit since 9/11 as have the mindsets of most people! The further we are from 9/11, the more people look at the facts surrounding 9/11, the less rational accepting this "little bit of inconvenience" becomes.

You are right. The airlines can tell you can't board their plane, or make procedure that are prohibitive, but the government can't inhibit your freedom to travel. The ones who think otherwise are authority worshipping psycopaths in my opinion. The thought of this being acceptable is a sign of a sick society.

I don't think the groping of body parts, or the forcing of cancer causing radiation is what Jesse had in mind by a little bit of inconveniece, nor has he said anything in the last almost decade to suggest otherwise. This guy is about the only one of celebrity status to actually do something about this, and for that I applaud him. It's petty to go back 10 years and take a quote from someone who was thinking the same way that alot of us, if not most of us were thinking that awful day.

if his argument is about unreasonable/unwarranted search and seizure, he has a chance. If he's arguing a "right to privacy", he'll lose. That "right" has been struck down several times by federal courts and at least once by the SCOTUS (as I recall).

It's more than this. TSA is a gov't entity, therefore it is bound by the Constitution and the Bill of Rights. Fourth amendment states that the people have a right against unreasonable search and seizure. There has to be probable cause, and just because you want to use air travel is not probable cause. Every time you are porn-scanned or molested your 4th amendment right is being violated.

Oh that's all true. But when you go into court you want to have as much ammo as possible. So you argue the constitution, but you also include the specific harm done to the client. Remember the warrantless wiretapping lawsuits? They got tossed because the judged deemed the plaintiffs couldn't prove "specific harm" because everybody was being violated. http://www.theregister.co.uk/2010/01/22/nsa_dismissal/ Now that's a perverse outcome, but that's our "just us" system.

I'm not debating that one way or the other. But in everything you play the hand you are dealt. And in the "just us" system playing the hand you are dealt means coming at them with the best story possible. If the law is on your side argue the facts. If the facts are on your side argue the law. If neither than argue policy. This TSA battle is probably one of the most frustrating things going, but it's also the easiest one to win IMO. Since 9/11 we've lost some and won some in the "just us" system. This one is quite winnable.
