At some point, the fact that most of the states have had their AGs oppose it would come into play. The more interesting argument is that the states consider it unconstitutional, and if the feds persist, the states will ignore the fedgov. If the states had the courage to actually do that, the SCOTUS would have to decide if it wanted to remain relevant.
