The 68-year-old grandfather of 12 who was killed yesterday by a Framingham police SWAT team in an early-morning drug raid was a retired MBTA worker described by shocked neighbors as the “nicest guy in the world.”

Eurie Stamps was not the target of the search warrant, according to the Middlesex District Attorney’s Office, and his death at the hands of police is under investigation.

Authorities said Stamps lived at the house with a woman whose son and another man were arrested in the raid on drug charges.

A report by police gave few details of the shooting, stat- ing only: “During the exec ution of the search warrant a firearm was discharged by a SWAT team member and a round struck a resident.”

Police wouldn’t say whether the shooting was justified. No weapons were recovered from the home, prosecutors said, and the suspects do not face weapons charges.

After Stamps was shot, police called an ambulance and gave him first aid, authorities said.

Joseph Bush fan, 20, the son of Stamps’ com panion, Norma Bushfan, was arrested outside the house as police initiated the raid. Bushfan allegedly was carrying eight baggies of crack and $400 in cash. Devon Talbert, 20, was arrested in a rear bedroom.

In court, prosecutors said Bushfan has open cases for armed robbery, assault with a dangerous weapon and larceny, but no convictions.

Sounds like a couple of weeks on desk duty while the state says "Oops, but they followed all proper procedures so no biggie". Those SWAT cops will be back on the streets murdering innocent elderly people in no time.

Hope they bankrupt the fucker.

Poetic Justice would have the cop living on the streets and being harrassed and beat by his former cop buddies, like Alex and his Droogs.

FRAMINGHAM — The family of the man killed by a Framingham SWAT team member during a 2011 raid of his home filed a wrongful death lawsuit Friday in federal court against the police department and the officer who fired the fatal round.

District Attorney Gerry Leone investigated and found Officer Paul Duncan fired the fatal shot from his M4 submachine gun accidentally after tripping inside a dark hallway in Eurie A. Stamps' Fountain Street home during a drug raid in the early morning of Jan. 5, 2011. The 68-year-old man's stepson, Joseph Bushfan, was a target of the raid.

The 32-page lawsuit, filed by Stamps' widow Norma Bushfan Stamps and his son Eurie A. Stamps Jr., claims the shooting was intentional and demands a jury trial.

"We’ve conducted our own investigation on behalf of the Stamps family and it is our view that the story that was told by the officer who fired the weapon is fundamentally inconsistent with the physical and forensic evidence," Boston attorney Anthony Tarricone said Friday.

The estate of Eurie A. Stamps Sr. seeks compensatory and punitive damages from Duncan, as an individual and as a Framingham police officer, and the town of Framingham.

The suit, in part, blames Stamps’ death on the town’s "policy or custom of grossly inadequate training and supervision of its police officers."

The town’s insurance attorney, Leonard Kesten, of the Boston law firm Brody Hardoon Perkins & Kesten, LLP, will represent the town.

Anticipating a lawsuit, selectmen have met several times behind closed doors to discuss it.

"It’s an unfortunate tragedy," Kesten said Friday after reviewing the complaint. "The town regrets what happened but every investigation has determined that this was a tragic accident and we’ll let the system of justice proceed."

Leone in March 2011 ruled Stamps’ death an accident and cleared Duncan of any criminal wrongdoing. He returned to the job from paid leave a month later.

Following the shooting, Police Chief Steven Carl assembled a community panel to look into the shooting, the SWAT team and its aftermath.

SWAT expert Steve Ijames, meanwhile, conducted an independent probe for the town that resulted in policy changes for the heavily armed team.

Carl told selectmen in January that his department reduced the size of the team from 18 members to 12, and was beefing up training, requiring four more hours each month.

Also, based on a recommendation from the Framingham Citizens Committee on Police in the Community, Carl said SWAT team members would keep their tactical weapons on "safe" mode until "the officer is ready to shoot."

Many in the "patriot" community have successfully gone against their bond. Insurance companies drop them, then they loss their job, basically. And if they had no bond to begin with, big trouble, personally.

Good for the family; however, it is unfortunate that they won't be able to sue the individual officers themselves. This legal immunity bullshit has gotta stop. If the shooting was not justified, cop or not, you should be held liable.

The interesting thing about this last part was that it implies that SWAT members always arrived with their weapons not only chambered, but on fire. That's a no no for tactical rifles. Even chambered and on safe, ARs without a firing pin safety spring can discharge unexpectedly if jostled hard enough.

Anyone who denies that we are in a police state anymore is just fooling themselves. Police can murder innocent citizens and get away with it no questions asked. Just imagine what these monsters are going to do when there is real unrest and not just government initiated black market drug dealing. Probably be mass graves at that point.
