TENNESSEE 2004

55 Total Delegates: 27 CD & 28 AL Primary: 2/10/04
Primary/State Exec. Committee Delegate filing: 12/11/03
Delegates bound for 2 ballots State Exec Committee: 2/28/04
Winner-take-all if over 50% in district or statewide;
Proportional w/20% threshold if not.

Step 1 – Delegate Filing

Purpose: To qualify to run as a national delegate on the primary ballot.

Timing: 12/11/03 at noon: Deadline to file nominating petition and declaration of candidacy.

Process: All delegate candidates must circulate and file petitions with the Secretary of State (using a prescribed form obtained from the Coordinator of Elections) of at least 100 registered voters (residing in the district for CD candidates). Tenn. Code Ann. § 2-13-305. Model nominating petition found at § 2-13-306. A declaration of candidacy containing, where applicable, a declaration of support for a particular presidential candidate, (using prescribed format and language) must also be filed with the nominating petitions. § 2-13-307. Candidate must declare that he either supports a particular
presidential candidate or is uncommitted. § 2-13-308.

For each CD, each presidential candidate must consent to at least one more than but not more than twice the number of delegate candidates being pledged to him than the total number of delegates allocated to the district (i.e., at least 4 delegate and 4 alternate candidates in each district but no more than 6 delegates or alternates per district. § 2-13- 309.

Step 2 – Presidential and Delegate Primary

Purpose: To elect and apportion CD and AL delegates based on the presidential primary vote.

Timing: 2/10/04

Qualifications: Open primary

Process: The CD delegates and alternate delegates are elected directly in the presidential primary. Each voter may cast a vote for as many delegate-candidates as there are to be delegates from such congressional district. § 2-13-312. Half of the AL delegates and alternate delegates are also elected directly in the presidential primary. The remaining 50% of the AL delegates and alternate delegates are appointed by the state party executive committee with the advice and consent of the presidential campaigns entitled to delegates and alternate delegates. The formula for allocating the CD delegates follows:
• A candidate receiving more than 50% of the primary vote in any CD is allocated all 3 delegates and alternate delegates from that CD.
• If no candidate receives 50% of the CD, the plurality winner (if receives more than 20%) is allocated 2 delegates and alternate delegates and the candidate receiving the next highest number of votes is allocated 1 delegate and alternate delegate. If the plurality winner receives more than 20% of the vote and the next highest candidate receives less than 20%, the plurality winner is allocated all 3 delegates and alternate delegates.
• If no candidate receives more than 20%, the three candidates receiving the greatest number of votes are allocated 1 delegate and alternate delegate each.
Rule C § 4-A.

The formula for allocating the AL delegates follows:
• If a candidate receives a majority of the vote statewide, he or she is allocated all of the AL delegates and alternate delegates.
• If no candidate receives a majority, the delegates and alternate delegates are allocated proportionally among the candidates who receive at least 20% of the statewide vote.
• If no candidate receives 20% of the statewide vote, the delegates and alternate delegates are proportionally allocated among the candidates based upon their percentage of the statewide vote.
Rule C § 4-B.

Step 3 – State Executive Committee Meeting

Purpose: To choose 50% of the AL delegates and alternates.

Timing: 2/28/04 (TN GOP, 1/6/04).

Process: The remaining number of delegates and alternates are selected by the State at large by the Executive Committee, with the advice and consent of the respective Presidential campaigns. Rule C § 2.

Step 4 – Certification of Delegation

Purpose: Filing of the credentials of the state delegation to the Secretary of the RNC.

Timing: 07/31/2004

Process: No later than thirty (30) days before the time set for the meeting of the national convention, the credentials of each delegate and alternate delegate shall be filed with the secretary of the Republican National Committee for use by the secretary in making up the temporary roll of the national convention (RNC Rule 18(c)).

Step 5 – Organizing Convention Delegation

Purpose: To select national convention delegation chairman and choose committee persons.

Timing: Promptly following selection of delegates.
Process: National Party Rules require the election of a delegation chairman, as well as one (1) man and one (1) woman for each of the four (4) Convention Committees, including: Committee on Resolutions (Platform), Committee on Credentials, Committee on Rules and Order of Business, and Committee on Permanent Organization. States are required to file notice with the RNC Secretary the selection of these committee members and their state delegation chairman. Alternate delegates may not serve as delegation chairman or as members of the convention committees (RNC Rules, Rule 40(a)).

Elector Selection

Purpose: To select presidential electors.

Timing: 5/6/04 – 9/2/04

Process: The State Executive Committee shall elect one elector for each congressional district and two electors for the state at large. Those selected will appear on the ballot as the electors representing the Republican candidates for President and Vice-President. Rule B § 2.

I am confused as to what exactly I can do as a delegate. Is this just to ensure for instance that if Ron Paul won the popular vote in TN that the delegates would actually vote for him and not someone else?

You get to make history at the national convention PERSONALLY voting to nominate Dr. Paul as our next president. ;)
