Step 1 – Presidential Caucuses

Purpose: To allocate and bind national convention delegates and alternate delegates.

Timing: On or before 12/31/03: Legislative district executive committees determine number of voting sites per district (Rules for the 2004 Republican Presidential Caucus
“2004 Caucus Rules,” ¶3, ¶7). 2/3/04: Presidential caucuses (2004 Caucus Rules, ¶2).

Qualifications: Persons who are eligible to vote in North Dakota and who either voted or affiliated with the Republican Party at the 2002 general election or intend to vote or affiliate with the Republican Party at the 2004 general election shall be entitled to vote at the 2004 Presidential Caucus (2004 Caucus Rules, ¶10).

Process: There will be at least one voting site for each legislative district and more as needed. The ballots for the presidential caucuses will contain the names of all announced candidates as of 01/01/2004, as stated by the Republican National Committee or the Federal Election Commission (2004 Caucus Rules, ¶8). The ballots are prepared by the state party and provided to each district (2004 Caucus Rules, ¶9). Each voter may vote for only one candidate (2004 Caucus Rules, ¶11). No absentee voting will be allowed (2004 Caucus Rules, ¶13).

Step 2 – District Committee Meetings

Purpose: To elect delegates and alternate delegates to the state convention.

Timing: Between 1/18/04 – 2/28/04

Qualifications: The Republican Precinct Committeemen elected or appointed as provided by law together with the Republican nominees for the members of the Legislative
Assembly of that party and the officers of the District Committee shall constitute the District Committee of the Republican Party. The District Committee by majority vote
appoint any former member of the Legislative Assembly as an ex-officio and voting member of such District Committee (ND Republican State Committee Rules and Modes of Procedure “ND Rules,” Art. VI, Sec 1).

Delegates and alternates to the State Republican Endorsing Convention must be of voting age (18) by the time the convention is called to order and must have lived in the
District for 30 days. In addition, delegates must have voted with the Republican Party in the last general election or intend to vote or affiliate with the Republican Party in the next general election (ND Rules, State Endorsing Convention Rule 3, §2).

Process: The state party rules and state statutes are silent on the specific process for electing state convention delegates and alternate delegates. Past practice indicates that registered Republican voters meet at the district convention to vote on the delegate slate (ND Conference Call).

The district committee of each state legislative district meets at a place designated by the chairman to elect delegates to a state party convention (ND Rules, State Endorsing
Convention Rules, Rule 3, §1). Precinct committeemen may call a precinct caucus prior to the district meeting to elect additional delegates to attend the district meeting. Delegates to the state convention are elected as provided by the state party’s bylaws. Delegates to the state convention must be electors of their district (ND Rules, State Endorsing Convention Rule 3, §2).

After becoming a District, an individual must fill out a delegate information form and pay a filing fee (app. $65). The district chairman signs the form to certify to the state (which must be forwarded to the state party at least 14 days prior to the State Convention) (ND Conference Call).

Step 3 – State Convention

Purpose: To elect national convention delegates and alternate delegates

Timing: 4/1/04 – 4/4/04.

Process: The Committee on Permanent Organization nominates a slate of national convention delegates and alternate delegates to the state convention (ND Rules, State Endorsing Convention Rules, Rule 11, §2). Potential delegate candidates must file an application with the national delegate nominating committee by 3/1/04 (see Delegate Application Form). The slate submitted by the Committee on Permanent Organization may be amended by the full convention (ND Conference Call).

Nominations may be made from the floor. However, only those persons who applied to the national delegate nominating committee but were not nominated are eligible to be nominated from the floor (ND Rules, State Endorsing Convention Rules, Rule 11, §2).

In the event nominations are made from the floor, a nominee must receive a majority of votes and finish in the top three in order to be elected (Id.). No unit rule voting is permitted (ND Rules, State Endorsing Convention Rules, Rule 14, §6).

If there is a contest for the delegate positions, the top vote winners become delegates until all delegate places are filled. The remaining candidates will become alternates (until all alternate places are filled) (ND Conference Call).

The Committee on Permanent Organization is composed of two members from each Region (see State Rules, Art. III, §4 for breakdown of regions) appointed by the Regional Chairman. The Chairmen of this Committee shall be the National Committeeman and National Committeewoman (ND Rules, State Endorsing Convention Rules, Rule 8, §4).

Step 5 – Organizing State Delegation

Purpose: To organize National Convention delegation and choose delegation leadership and members of the Convention Committees from the state.

Timing: Promptly following their election (RNC Rule 40(a)). Sunday afternoon, 4/4/04 (ND Conference Call).

Process: National Party Rules require the election of one (1) man and one (1) woman for each of the four (4) Convention Committees, including: Committee on Resolutions (Platform), Committee on Credentials, Committee on Rules and Order of Business, and Committee on Permanent Organization. States are required to file notice with the RNC Secretary the selection of these committee members and their state delegation chairman. Alternate delegates may not serve as delegation chairman or as members of the convention committees (RNC Rules, Rule 40(a)).

Step 6 – Certifying Delegates to the RNC

Purpose: Filing of the credentials of the state delegation to the Secretary of the RNC.

Timing: 7/31/04

Process: No later than thirty (30) days before the time set for the meeting of the national convention, the credentials of each delegate and alternate delegate shall be filed with the secretary of the Republican National Committee for use by the secretary in making up the temporary roll of the national convention (RNC Rule 18(c)).

Presidential Electors

The State Party Convention shall nominate the legal number of candidates for its party for the offices of presidential electors (ND Code, §16.1-03- 14(1)).

The names of the candidates nominated for presidential electors with the surname of the presidential candidate the party wishes to place on the general election ballot must be certified by the chairman and secretary of the convention to the secretary of state by four p.m. on the sixtieth day before the general election to be placed upon the general election ballot (ND Code, §16.1-03-14).

The Committee on Permanent Organization will present a slate of three electors to represent the Republican Candidate for President on the North Dakota General Election Ballot. Nominations may be made from the floor. In the even nominations are made from the floor, a nominee must receive a majority of votes and finish in the top three in order to be elected (ND Rules, State Endorsing Convention Rules, Rule 11, §3).

Other Information

• Delegates are bound for the first ballot only (Rules for 2004 Republican Presidential
Caucus, ¶1 and ND Rules, State Endorsing Convention Rules, Rule 20).
• Delegates are allocated to presidential candidates proportionally on the basis of the
caucus results (Id.).
