The 2011 Earmark Reformation & Transparency Act
1. Earmark Reform:
A. All “earmarked” legislation must be submitted to the Committee on Appropriations – in either the House or Senate, depending on who introduced the bill, as both have a Committee on Appropriations. No “earmarks” can be introduced in the conference phase.
B. No military related “earmarked” spending can be added to non-military legislation.
C. No non-military “earmarked” spending can be added to any military legislation.
D. All earmarked spending must be in-relation to a balanced-budget (That could be phased-in over a 3 to 5 year period in-order to make it palatable for moderates, we do want to reach a compromise).
2. Transparency (These proposals are from the Legislative Transparency and Accountability Act of 2006 with some tweaks):
A. All Senate bills or conference reports include a list of all earmarks in the measure.
B. Members of Congress who propose an earmark be identified.
C. Earmark proposals be accompanied by an explanation of its essential government purpose.
D. All bills or conference reports, including the list of earmarks, be available to the Senate and to the general public on the Internet for at least 7 days before its consideration.
E. Senators be given the right to try to remove earmarks from any bill that moves onto the floor. An earmark could be removed from legislation with the support of sixty senators (without striking down the entire bill).
