The thought just occurred to me that the RightHaven situation presents be a great opportunity for our voluntarist contingents to show some leadership regarding a free-market policing itself

Mike, I think that'd be WAY TOO opportunistic, and not even too appropriate.

The market today, already HAS mechanisms such as DMCA, and all ISPs comply.

Righthaven lawsuits are clearly shakedowns, or else they'd not do so many, and brag about it. If they were serious about copyright protection and avoiding the use of courts, they'd do ONE BIG lawsuits, not hundreds of little ones.

If you had any "free market" absent of the current copyright laws, you'd still have corporations forming their own courts to bully little guys. I believe copyright laws provide a reasonable buffer to prevent the bullies from abusing them, and still protecting profits for the originator from malicious infringement.
