The U.S. Supreme Court did not know how to excercize its power or what to do with itself until Marbury versus Madison in 1803. Until then, Constitutionality wasn't determined by the Supreme Court, but by way of the two party system. If you wanted to determine what was constitutional, then you had to win power to do so. As the only thing certain has been declared so as self evident and unalienable within the formal document of The Declaration of Independence, nothing has been, can, or ever will be found certain within The U.S. Constitution. The only thing certain about The U.S. Constitution is that it is supposed to serve as a necessary tyranny over the established Civil Purpose of the American people in The Declaration of Independence.
