Homeowner: "I shot police officer in self defense"

A Garland County homeowner says he shot a police officer in self defense. It's the latest turn in the Diamondhead police shooting earlier this week. We're also learning a lot more about officer Fred Ensminger's past.

Diamondhead Police Chief Pat Mahoney wouldn't allow us on property Thursday, so today we came back with a resident escorting us around the area.

We wanted to get Jerry Chambliss's side of the story, why he got in a shootout with a police officer Wednesday. Chambliss wasn't home, but he did answer his phone.

"As the night wore on the handcuffs got looser, that's the way I like to say it," Chambliss says.

Police say officer John Frederick Ensminger, off-duty and in an unmarked truck, followed a woman to her home. The woman, frightened, called her husband Jerry Chambliss, who then called police.

After Chambliss called police, he came to the edge of his driveway to meet his wife. She pulled into the driveway. When he saw officer Ensminger in his truck behind her, he says that's when the situation got much worse.

"He came in and I put my arms up and I said no, don't come on the property, just stop and tell me what’s going on,” Chambliss says. “And he just wizzed in there and ran over me."

Chambliss says he still has no idea what prompted Ensminger to follow his wife.

"He never said a word, never showed a badge, never had lights, no uniform, no nothing," Chambliss says.

This is not the first officer involved shooting for Fred Ensminger. He shot a suspect who ran from him in December 2005 as a cop in Alexander. In the state police report, Ensminger states the suspect took his hands out of his pockets and he saw a something shiny he thought was a gun. It was later determined the shiny items were compact discs.

The Pulaski County prosecutors office issued a report in January 2006 saying his use of deadly force was justified in that shooting.

In June 2006, Pulaski County deputies sent Ensminger to jail for getting into a fight with his girlfriend in the parking lot of the Alexander Police Department. He resigned the next day.

Ensminger was also fired as an officer in Shannon Hills for an alleged assault in March 2005.

Chambliss says he'd never seen or heard of officer Ensminger until two days ago.

"He shot first, I can tell you that,” Chambliss says. “It was 100% total complete self defense I assure you, otherwise the cops would've arrested me, they know."

The shooting is still under investigation. We're expected to know whether the prosecutor will file charges against Chambliss or officer Ensminger perhaps as early as next week.

I also tried to talk to the Diamondhead Police Chief about Ensminger's checkered past, but he wasn't in his office and did not return any messages left for him.

Ensminger was shot in the shoulder and is recovering in a Hot Springs hospital.

Mahoney tells FOX16 News it's just the third shooting in the Diamondhead gated community in the last 10 years.

The Pulaski County prosecutors office issued a report in January 2006 saying his use of deadly force was justified in that shooting.

In June 2006, Pulaski County deputies sent Ensminger to jail for getting into a fight with his girlfriend in the parking lot of the Alexander Police Department. He resigned the next day.

Ensminger was also fired as an officer in Shannon Hills for an alleged assault in March 2005.

Whats even more interesting is what this asshole did to my assistant about a month ago. It would appear that Diamondhead police department needs to review its policy on how it handles peeing felons ( yes peeing felons). Then the chief of police walks up into my yard after I witness Fred kicking the shite of of my help who is handcuffed on the ground and acts like he wants to make it all Official. I don't really have time to fully respond to this but long story short they beat him at the jail for no reason later that night. Twice in one night over rolling over while handcuffed and taking a leak. I have police reports, pleadings, and more pleadings coming.

If I had a gun one night a month before I would have shot the bastard, in the mean time I am being called as a witness concerning several predicate offenses under the Federal RICO statute. Not only did Jerry shoot him in self defense he made a spontaneous declaration to that effect to the investigating officers and never even had to go downtown.

I doubt that it is. Leaving out "the" is typical of news headlines. But does this guy really like that? And why, if he really said that, did he explicitly say that the person he shot was a police officer? I know him personally, he lives nearby, his lawyer called me the other day concerning depositions in the civil suit concerning this case, It was in numerous local papers, the local prosecutor declined to charge him concerning this shooting. Its common knowledge in the area and he even wrote about in the comments sections in the local paper that is how I met him. Would you like for me to have him call you and tell you the whole story. They had a full blown shoot out in his yard and the thug officer got shot, how else to you shoot an thug with a gun and badge and get by with it ?

Jessiveille man who allegedly broke woman's leg arrested

A Jessieville man was arrested Wednesday on felony and misdemeanor warrants for allegedly breaking his wife's leg last month.

John Fredrick Ensminger, 52, was taken into custody shortly after 3 p.m. and charged with second-degree domestic battery, punishable by up to 20 years in prison, first-degree terroristic threatening, punishable by up to six years, and third-degree domestic battery, punishable by up to one year. He bonded out and is set to appear Oct. 4 in Garland County District Court.

According to the affidavit, the victim filed a report on Aug. 28 about an assault that allegedly occurred Aug. 16 around 6 p.m. She said Ensminger, her husband, pulled her out of her chair by her hair and threw her around the room "like a doll." She said Ensminger also punched and elbowed her in the left side of her face. She went to bed after Ensminger stopped assaulting her, but then he pulled her off the bed by her feet, slammed her against the wall and began to choke her, causing her to lose consciousness.

The victim said she did not recall anything else from that night, but woke up in her car with her daughter driving her to Malvern. She waited a week to seek medical treatment because "she was afraid." The victim said Ensminger told her, "he would kill her before he let her leave him and that he was not going to lose his job or go to jail."

The victim suffered injuries including a broken right leg, fractured left orbital socket, sprained right elbow, bruises on her stomach, back and legs, and bruising and swelling to the left side of her face.

She reported a second incident that allegedly occurred on Aug. 24, after Ensminger found out the victim sought medical treatment. She said he grabbed her by the arms, throwing her around the room several times. In the second attack, the victim reportedly sustained bruises on her upper arms, thighs, lower back and right side. She was also observed to have a cast on her right leg.

• A Hot Springs couple were arrested Wednesday morning after allegedly battering each other with multiple objects.

Steven Allen Hayes, 39, and Nicole Leighann Hayes, 39, of 112 Piney Loop, were taken into custody shortly after 8:30 a.m. and each charged with third-degree domestic battery, punishable by up to one year in jail. Steven Hayes bonded out, but Nicole Hayes remained in custody Thursday in lieu of zero bond. They are set to appear Oct. 10 in district court.

According to the affidavit, Nicole Hayes said she and her husband, Steven Hayes, were arguing and he threw her against a wall and began hitting her. She said he dragged her through the house and into the front yard where he threw her to the ground. He fled the scene and she called 911. Garland County sheriff's deputies noted Nicole Hayes had abrasions and bruises to her face, neck, back and arms.

Steven Hayes returned to the residence and told a deputy that Nicole Hayes had returned home the night before at 10:45 p.m. after being gone all weekend. He said she kicked in the front door to their residence and started arguing and then took picture frames off the walls and threw them at him. She also grabbed a BB gun and hit him in the head and while lunging at him with a screwdriver, scratched him on his right side, he said.

Steven Hayes was observed to have scratches and cuts on his forearms, a small knot and a cut on his head from the BB gun, and had scratches on his arms, legs and back from the thrown picture frames.

He said he pushed Nicole Hayes several times to get away from her and finally left the residence to take his kids to school. Nicole Hayes said she only hit him to protect herself.

These laws have probably been on the books for decades, and are only getting into rotation as prosecutions because they are what boobus currently considers scary and therefore beyond question.

If it wasn't terrorism, it would be some other bullshit already on the books that they'd stick on him.
