I received my copy of Nullification during Independence Day weekend. I’m familiar with the political theory, have written in support of it (http://www.connorboyack.com/blog/nullification-a-necessary-power-for-state-sovereignty), and have a good grasp of its history and implications.

But as I was reading through Woods’ persuasive compilation of examples and arguments, a thought struck me clearly and energetically: this book needs to be read by those who can actually implement the ideas.

Over the next few minutes, the simple (yet potentially monumental) project came together: raise enough money to buy a copy of the book for every state legislator in Utah. Our state has already in the past nullified federal laws, such as with No Child Left Behind (http://www.msnbc.msn.com/id/7713931/), REAL ID (http://blog.tenthamendmentcenter.com/2010/04/utah-governor-signs-law-nullifying-real-id/), firearms regulation (http://www.campaignforliberty.com/blog.php?view=33182), and health care (http://blog.tenthamendmentcenter.com/2010/03/utah-governor-signs-health-care-freedom-act/). These are excellent examples of the power of nullification, and the success Utah has had in defending its sovereign powers, reserved to itself and us Utahns under the tenth amendment to the U.S. Constitution.

It doesn’t—and shouldn’t—stop there. While these are great strides in the movement towards liberty and a constitutionally-limited government, there is much more that can be done. The entire state legislature would do well to read and understand the arguments presented in Nullification, and commit to advancing additional legislation that would continue this trend.

The success of this project depends not only upon the grassroots donations of interested Utahs, but the persistence and persuasion of citizens around the state in order to ensure that each legislator reads and comprehends the subject matter. It’s easy to buy and mail a book. It’s not as easy to get someone to read and understand it.

This book, however, is a must-read for those who have been entrusted with protecting Utahns in the enjoyment of their life, liberty, and pursuit of happiness. Our federal government has repeatedly overstepped its bounds; now is the time when our state legislature must apply pressure to check the federal government and restore the liberties we are losing. Nullification is how it can be done.

On the heels of the release of bestselling author Thomas E. Woods' new book "Nullification: How to Resist Federal Tyranny in the 21st Century (https://www.amazon.com/dp/1596981490?tag=nullifynow-20&camp=213381&creative=390973&linkCode=as4&creativeASIN=1596981490&adid=0F58YNSVEP6CYX3YAZ4Q&)", a local political activist has launched a project to put the book in the hands of every Utah legislator.

In his latest book, Woods, a Senior Fellow at the Ludwig von Mises Institute, explains the history, purpose and effective use of state nullification as a check on federal laws and programs that exceed constitutional authority.

Political activist Connor Boyack says he has launched a drive to raise enough money to purchase a copy of Woods' book for every state lawmaker.

"Nullification is for the protection of liberty, for the protection of private property," Boyack says. "When you have an encroaching federal government, I don't care what party you're a member of.

"Nullification is a responsibility and the opportunity for state legislatures to interpose and say, 'We aceded to the union. We made this contract. You have exceeded the bounds of that contract. We are not going to comply.'

"Again, nullification has been used throughout our history. It's been used historically. It's been used very recently. I think it's going to continue to be used."

Boyack made the comments on KVNU's For the People program. He says the ideas in the book are crucial in our political climate today.

We ought to take up donations and buy and ship every state legislature member and every governor a copy of the book. We could do it state by state. Get a rep for each state. Imagine the fallout if every state legislator go a copy of this book.

Well, just as I was about to purchase the books, I saw that Amazon (the cheapest place to get them) had increased their price by $3 per book. When you’re ordering 100+ books, that adds up quick! So we had to increase our goal from $2,000 to $2,300 to compensate. We’re getting close!

On Monday I’ll be ordering the books from the publisher, whose bulk discount was not cheaper than Amazon’s original price, but now is slightly cheaper after Amazon’s price hike. In the next couple of weeks I’ll be putting together a draft of the letter that will be included in each book we’ll be sending to every Utah legislator, as well as emailed directly to them in anticipation of the book’s arrival. Stay tuned for that draft which I’ll post here for your reviewing pleasure.

We’ve gotten a lot of positive feedback on this project and are very encouraged by the many donations that have been made in its support. We’re just a few hundred dollars away from raising the total amount needed — please donate and encourage your friends, family, neighbors, and co-workers to do the same!

On Independence Day weekend just a couple months ago, I was reading Tom Woods’ new book Nullification: How to Resist Federal Tyranny in the 21st Century (http://utah.tenthamendmentcenter.com/2010/09/an-update-on-the-utah-nullification-project/www.amazon.com/Nullification-Resist-Federal-Tyranny-Century/dp/1596981490). As I was reading through the excellent book, I had a realization: if the subject matter was to have any impact on our current political landscape, it needs to get into the hands of the state legislators who can immediately do something about it.

Thus, the Utah Nullification Project (http://www.utahnullification.com/) was born.

Within just a few weeks, we were able to raise the $2,000 needed to buy a copy of the book for every state legislator here in Utah. The books have now been received. We’re currently drafting the letter that will be included with each book, to give the legislator a brief introduction to the concept of nullification, and why it’s important they read the book. Then, once the November elections are over, and we have a tally of who all was elected, we will begin the process of mailing out the books.

We’re very excited to get into the next phase of this project and start getting the books into the hands of each legislator. Here in Utah we’ve been able to use nullification a few times (though not in name), and with the current political climate, we’re hopeful that the trend will continue and increase.

A key to achieving this goal is to ensure that each legislator understands the history and proper use of the doctrine of nullification, so that they are better informed and equipped when a bill or topic comes to their attention that merits use of such resistance. Owning a copy of this book, whether for reading immediately or referencing later, will be an important step in promoting nullification in Utah.

Now that the election has passed and we know who the legislators will be for the next two years, it’s time to ship the books! Below is the letter that will be included with each book. More updates soon!



Dear Utah Legislator,

The energy leading up to the recent election provides an interesting example of how concerned Utahns are about a host of issues. While worry about the economy certainly was a predominant theme, one of the more significant concerns expressed throughout this campaign cycle, by Utahns and others around the country, was the intrusiveness and recklessness of the federal government.

We at the Tenth Amendment Center are extremely sympathetic to this concern, and feel that for far too many decades, the federal government has assumed more powers than it was delegated under the U. S. Constitution. Our goal is to help educate Americans about the principles of federalism and help promote and support legislation that will defend individual rights.

The book in your hands is a recent work by Thomas Woods on the concept of nullification—a political doctrine which, though its name is not often invoked, has been implemented throughout our nation’s history. As you will learn in the book, nullification occurs when an unconstitutional law is rejected as an abuse of authority. At a state level, it occurs when the legislature passes a law where they explicitly state that a federal law has exceeded the contractual authority the federal government was given, and is therefore of no force within the boundaries of the state. In Federalist 78, Alexander Hamilton wrote:

There is no position which depends on clearer principles, than that every act of a delegated authority, contrary to the tenor of the commission under which it is exercised, is void. No legislative act, therefore, contrary to the Constitution, can be valid. To deny this, would be to affirm, that the deputy is greater than his principal; that the servant is above his master; that the representatives of the people are superior to the people themselves; that men acting by virtue of powers, may do not only what their powers do not authorize, but what they forbid.

This may sound controversial, and to be frank, it often is. But it’s an important tool both to understand and to use in order to efficiently oppose the continual arrogation of authority by the federal government. Nullification has been successfully used to protect individuals from: invasion of their privacy; punishment for political speech; violations of due process and habeas corpus; burdensome regulation and taxation; unfunded federal mandates; and more. Utah, too, has nullified federal laws, including two in the last session.

It is in your power to protect Utahns—both by ensuring our state laws protect individual liberty, and by resisting federal laws that have no constitutional authority. Your voice of resistance will be seen by Utahns as leadership in defending our rights and upholding the U.S. Constitution. This is something you have taken an oath to do. Nullification can help. We at the Tenth Amendment Center stand ready to help in whatever way possible.

We look forward to working together with you in advancing these principles.
