Graham signals clear road for Kagan

Supreme Court nominee Elena Kagan is riling the right, but her path looks pretty clear for confirmation.

The Judicial Confirmation Network is honing in on her lack of experience as a judge, but Sen. Lindsey Graham, R-S.C., sent out this tea leaf:

"Solicitor General Kagan has a strong academic background in the law. I have been generally pleased with her job performance as Solicitor General, particularly regarding legal issues related to the War on Terror. I look forward to meeting her again, this time to discuss her qualifications to sit on the highest court in the land."

WASHINGTON – Senator Joe Lieberman (I-CT) today issued the following statement in response to President Obama’s nomination of Elena Kagan for the Supreme Court:

“I commend President Obama’s nomination of Solicitor General Elena Kagan for the position of Associate Justice of the Supreme Court. I begin the process with very positive thoughts about this nominee. Elena Kagan is a distinguished lawyer and legal scholar with a lifelong commitment to public service. I am hopeful that we will see a strong bipartisan effort to undertake a thoughtful and fair confirmation process in the Senate.”

During her hearings to be confirmed as Solicitor General, the New York Times paraphrases Kagan as saying "that someone suspected of helping finance Al Qaeda should be subject to battlefield law -- indefinite detention without a trial -- even if he were captured in a place like the Philippines rather than a physical battle zone

Then this confirmation process is all a dog and pony show. The Democrats have their 60 votes, 59 Democrats + Lindsey Graham. Expect some interesting things to go on during this confirmation. If I remember correctly, last time there was a few things done under the veil of the confirmation hearings.

No doubt Al Qaeda has ended up with US government money at a some point. Looks like all US Taxpayers will be subject to "indefinite detention without a trial ".

Bill Clinton and George Soros helped finance Al Qaeda in Kosovo. Time to round them up.

We need to add Scott Brown to the list of probable GOP supporters of Kagan. Shocking! :rolleyes:

This will fit in nicely with most of Brown's other votes, including his vote against a full Audit of the Fed.

Two other GOP votes are perceived to be on the fence, and the lobbying for them will surely be intense from both sides: Massachusetts' new Senator, Scott Brown, and South Carolina's Lindsey Graham (who missed the last vote on Kagan).
