Thank you. This is really the impression of Ron Paul Forums I'm hoping people get. I'm so glad this is in General Politics. It would be just silly if someone couldn't find something more to criticize about her than her ugliness, percieved sexuality, and some random other cliches thrown in. I'm glad your well-researched opinion is here instead, so that no one thinks this place is populated by people that shallow and ignorant.

Kagan Invokes Myth-Of-Neutrality, My-Views-Don’t-Effect-My-Viewing View To Avoid Revealing Her View Of Constitution

Supreme Court nominee Elena Kagan, at the time Solicitor General of the United States, said, in a Public Radio interview (12/22/09), when asked about her views re: the U.S. Constitution: “What my constitutional values are are wholly irrelevant to the job, and so neither you nor anyone else will know what they are…What my political views are, what my constitutional views are just doesn’t matter.”

Well, now. The next thing I always want to hear said to a person who says this kind of thing is something like this (with a big smile): “Fine. Wonderful. Congratulations on your ability to compartmentalize! — to be objective!, to approach matters in a totally unbiased manner! I wish I had that talent.

“So, since what you believe is wholly irrelevant to your job you can now tell me what you believe! — no problem! No problem because your beliefs have nothing to do with your job!”

But, of course, Kagan’s views re: the Constitution matter. She knows this. She knows that others know that her views matter. And this is why she has refused to say what her views are.

Kagan’s views on the Constitution mattered when she was Solicitor General representing the U.S. before the Supreme Court. They matter now that she has been nominated to sit on the Supreme Court.

The absurd my-views-don’t-effect-how-I-view—things-view is designed to perpetuate The Myth Of Neutrality. But, no one views anything “neutrally.” There is no view from nowhere. All people view everything from some perspective, according to some presupposition, according to some frame of reference into which they integrate all facts, all that they see and hear.

And it is precisely because presuppositions — “personal views” — determine interpretations that the most important questions Kagan could (but, alas, will not be) asked in her confirmation hearing would be questions about her “personal views,” her presuppositions, her assumptions, her standards, according to which — for good or evil — she judges all things.

Such questions would include such questions about such basics as: Where do you think law originates?; is there an ultimate law-maker?; Does law change?; if so, how can there be a fixed standard of justice?; by what standard would you judge a law to be just or unjust?; in what way, if any, would God’s Law effect your judging?; what is your definition of justice? What is the role of a judge?

I would add that my personal experience has been that when folks like Kagan say what Kagan said in her Public Radio interview it is to cover up views, usually views that are very Liberal, way over on the Left.

— A “Christian” web site has noted, critically, that Kagan once wrote a memo while clerking for the late Supreme Court Justice Thurgood Marshall saying religious organizations that provide care for teen pregnancies shouldn’t get Federal funds because of a strict line separating church and state. True! They should not be Federally funded because such funding is outside God’s limits on civil government; such funding is unConstitutional.

— The conservative Susan B. Anthony List has complained: “Elena Kagan has no judicial record from which to determine her position on Roe v. Wade.” So what? We must ignore Roe. Stop making it the centerpiece of our pro-life concerns. Roe is nothing!

It is just an “opinion;” not law. As pro-lifers, we must concentrate on trying to get abortion prosecuted for what it is — murder.

And what modern Presidential introduction of a Supreme Court nomineee would be complete without the nominator and nominee both demonstrating they are clueless re: the form of government our Founders left us? Once in his introduction of Kagan, President Obama referred to our country as a “democracy.” Kagan referred twice to our country as a “democracy.” Arghhhhhhhhhhhhhhhhhhhhhh!
