First off, I find it totally unfair that they are holding the national organization responsible on the grounds of the fact that this was a Mormon troop alone. The national organization holds authority over for them on mere paper only. The local leadership of the Mormon church runs their troops with little outside interference.

I imagine there's plenty of grounds for appeal littered throughout the trial.

Not saying anything about the judge there, only that the BSA's lawyers wouldn't be doing their job if they didn't make plenty of good legal arguments and objections on points of law for the Court of Appeals to hear.
