Whatever did they do with uncooperative seven month pregnant ladies before the use of tasers anyways? Any toad that cannot figure out how to handle the situation better than this needs fired. All this for failure to sign a ticket for 12 miles over the limit. Egads!!!

Here's the hard link: http://www.metnews.com/articles/2010/broo032910.htm

udge Diarmuid F. O’Scannlain joined Hall in her opinion, but Judge Marsha S. Berzon dissented.

“I fail utterly to comprehend how my colleagues are able to conclude that it was objectively reasonable to use any force against Brooks, let alone three activations of a Taser, in response to such a trivial offense,” Berzon said. “Obviously, the sensible reaction to [Brooks’] refusal to acknowledge the ticket in writing would have been to so note on the ticket and send her on her way.”

I'm with you Marsha.

I guess the fact that its a minor ticket offense never really crossed anyone's mind. It's all about "obstructing" the officer's attempt to "carry out his duties of enforcing the law".

Just wait till that out of control bunch of black robes rule in favor of O care and they will. This lawsuit by the states will end badly and was unnecessary. I think it was a trick.

The whole "pain compliance" thing should send red flags to everyone we are firmly within the police-state territory.

Any and everything is O.K. if the supreme's say so. Right and wrong or common sense does not apply, especially to the police state goons.

Morally right of course not and they laugh that you might throw that in there.

Dangerous to the baby, of course, why do you think they love it so.

It's really the job of the state legislatures to outlaw this, not the courts.

They must ask the fetus to consent to being tazered. Silence is considered consent.

Open season on the preggies!

Yeah, apparently "serve and protect" went out the window a long time ago with some of these knuckleheads.

But the (original) judge summed it up best. Just note it on her ticket refusal to sign and send her on her way?

Taser for not signing?

More proof that the State is wonderful, hunkey-dorey, fantabulous! Look how it protects us! This one gets the Torchbearer "Government Is Great" stamp of approval. ;)

My summary of what happened.

"License and Registration."

"ok"

"How fast do you think you were going?"

"I wasn't speeding."

"Yes you were. Sign the ticket."

"No I wasn't."

"Don't sign the ticket you're gonna suffer..."

"You're crazy. Don't threaten me."

"See this tazer? It's gonna hurt..."

Cop breaks into car -tazes her 3 times.

Judge says cop is in the right.

Signing the ticket is not an admission of guilt. It is a promise to appear in court. Put "without prejudice" to the left of the signature and sign it. Regarding tasers on pregnant women... what kind of sick bastard would do something like this? Seriously... people who would do this deserve to be locked up in a freaking psych ward.
