But what I want to see is some nullification coming from the states, not Federal lawsuits filed by state officials

I agree. Nullification!

Instead of implicitly acknowledging Federal authority over the states by suing in a Federal court, each state legislature should pass a law declaring the health care bill unconstitutional, and instructing the state's attorney general to protect state residents from any Federal agents that try to enforce it.

Couldn't agree more. Obama knows these lawsuits will go nowhere. That's why he said, "Bring it on."

Why not do both? The states have a good case against being forced to expand their medicaid rolls.

That said, it's easy to sit around and say "nullify". Does anyone have any idea how exactly that would work? This is going to be enforced by the IRS. Are states going to start sending in state troopers to shut down IRS offices? Short of that.....?

The Healthcare Freedom Act changes the State Constitution to make it illegal for the Federal Government to force you to buy healthcare. Quite clever.

As long as it goes far enough (has standing yadayadayada) then
that would be with a judge issued ruling,
rather than the media or the internet concluding the merits or deficiencies of a case without knowing very much other than superficial matters.

And then subsequently, the battle can get defined better and improved - it is not futile effort always if an unsuccessful outcome.

I don't trust the Court system. Nullification is the way to go.

Several parts of the FDR power grab were thrown out by SCOTUS. I don't see why we can't fight it on both fronts.

Exactly. Not to mention bank account seizures, property liens...the only thing they can't legitimately do is knock on your door without the Sheriff being there.

Nullification means they ignore the law. No need for lawsuits or legislation..they would simply ignore it. tones

"Ignore" is the wrong term to use. You make it illegal in the State Constitution.
