Gubernatorial hopefuls promise to fight against the reform bill passed Sunday

Democrats’ success in passing historic health care reform legislation added yet another element to Iowa’s already heated gubernatorial contest, with two of the three men running for the Republican nomination promising they would make the fight against its enactment a priority if elected.

But legal experts say that the political rhetoric on display by opponents of health care reform doesn’t match up with the constitutional reality.

Days before Democrats were certain they had mustered the votes in the U.S. House to pass a health care bill, Republican gubernatorial hopeful Bob Vander Plaats (http://iowaindependent.com/tag/bob-vander-plaats) was already vowing that if elected he would invoke the U.S. Constitution’s 10th Amendment (http://okhenderson.com/2010/03/18/vander-plaats-would-invoke-10th-amendment-if-health-care-bill-passes/) to block it in the Hawkeye State.

Not to be outdone, state Rep. Rod Roberts (http://iowaindependent.com/tag/rod-roberts), R-Carroll, who is one of Vander Plaats’ rivals for the GOP gubernatorial nomination, filed amendments to two bills in the Iowa House aimed at blocking a federal mandate for individuals (http://www.iowapolitics.com/index.iml?Article=189761) to purchase health insurance.

“If President Obama and Democrats in Washington, D.C., force health care decisions upon Iowans, I will stand up for the people of Iowa and defend our state’s sovereignty,” Roberts said. “Now is the time for action. I have a plan to defend Iowans’ constitutional rights.”

Both men are pointing to the Tenth Amendment, which says that powers not delegated to the federal government are reserved for the states, a line of argument Republicans across the country have keyed in on. They say Congress lacks the authority to compel people to purchase health insurance, or pay a tax or a fine if they do not.

Bills have been introduced in at least 36 state legislatures seeking to limit or oppose various aspects of the reform plan through laws or state constitutional amendments, according to the National Conference of State Legislatures. Only two states, Idaho and Virginia, have enacted laws, while an Arizona constitutional amendment is seeking voter approval on the November ballot.

curious? is the iowa gop gonna stop health insurance companies from approving surgerys .then after surgery denying it??
if the gop wants to start winning the healthcare debate. what are they doing to stop average americans from having insurance and having companies screw them for 250,000????

i am against obamacare but i find the gop shouting against obama care not solving a single problem with the scam of insurance companies making money of insurance payers(like ourselves) our insurance company ameriben made record profits ,while they bankrupted us!!

I feel the gop is ignoring the real problems. the insurance industry! either way obama/gop the insurance industry wins. while consumers get screwed!!

Whether we like it or not the first step is killing the new bill. The next step should be killing the HMO Act. With those two out of the picture insurance will normalize.

I am not even remotely convinced that insurance companies are doing these types of things, if they are then they can be dealt with under EXISTING laws. Breach of contract and fraud are already covered. This is a STATEs issue. Enforcement should of existing laws falls to them.

Whether we like it or not the first step is killing the new bill. The next step should be killing the HMO Act. With those two out of the picture insurance will normalize.

I would love to see a state kill Obamacare and HMOs, and allow free market comepetition in insurance without mandates. This would instantly make insurance as cheap as it possibly could get WITHOUT buracracies.

well, we do not have 25-50,000 to fight the insurance companies. In the end we will have to allow the doctors and the state to pursue. even with our approval letters lawyers want lots of money. we are going to continue to try to find a pro-bono attorney but in the end. we are broke and eventually the state will have to fight the company. we now have to get free medical care!

enforcement of exisiting laws?? please do not make me laugh;)
