Call me cynical, but this is not a good thing. Of course this is illegal, of course this is unconstitutional, but I don't think Mark Levin should be the one filing a lawsuit. It will be a spectacle, and a charade, and will be set up to fail so that the wind will be taken out of the sails of legitamite lawsuits.

This should be challenged by real citizens, not some disc jockey who just a couple of years ago would be defending the same stunts by Bush if it was under the guise of "national security".

I agree with Napalitano. This is a red herring, and of course a neocon like Levin will focus on this instead of the unconstitutionality of the bill itself. This court will say, take up the procedure with congress, not with us.

If anything, Mark Levin will unwittingly help get more sheeple off the couches and out helping to throw everyone out of Congress. Publicity can serve a useful purpose even if the case fails.

I still contend that the only answer to this is to use to states.

Otherwise we are at the mercy of Congress.
