just bullhorning an intersection in Austin, another Thursday protest.

These guys wore lucky the cop was a total idiot and not a hot head otherwise they could have gotten tazed and arrested for no reason because only in America people fear the police.. :D

Is this legit at all? His website sure is cheesy... but it looks like he made it himself so he gets points for effort. I'm tempted just so I have something to read tonight.

Actually, the cop was right about Austin municipal ordinance.

The demonstrators look like they are in front of a business, so Section 9-2-4 applies:

A person may not operate sound equipment at a business that produces sound:

(1) in excess of 85 decibels between 10:00 a.m. and 2:00 a.m., as measured at the property line of the business; or

(2) is audible at the property line of the business between 2:00 a.m. and 10:00 a.m.

A vacuum cleaner makes about 85 decibels. A bullhorn can easily exceed that. Most are designed to exceed 100db.

Question I have is what time this was at... If was after 10pm, the cop was on solid legal ground.

If they measure it at the property line and the only thing making noise is the bullhorn, then its definitely possible.

The next question then is whether the cops have the equipment to take those measurements.

Doesnt that sort of business ordinance look like its meant to be applied to businesses that are operating equipment and not somebody who is protesting outside of a business?

Not in the greater context of the municipal code.

When read with all the other ordinances, the "at a business" part clearly shows its authors meant a commercial zone. The business itself doesn't need to be making the noise (as the ordinance specifically applies to people).

I still cant get the 3rd video to play.. WTF... it goes for a few seconds and just freezes.. like youtube is fucked up.. but everything else is working.. just not that part 3 video.. oh well.. ill try it again tomorrow.. i have a feeling the 3rd part is the best part

The problem is the cop didn't even know the ordinance he just shot from the hip like most cops do. If he did know the ordinance he should have cited it and been done with it.

Also like some one else said the decibel level of a bullhorn is higher than 85 but so is every asshole honking their horn every five minutes. So are the cops going to harrass everybody honking their horn? The problem is it's a dumb law enforcable only by retards.
