Even though police are tapping into the locations of mobile phones thousands of times a year, the legal ground rules remain unclear, and federal privacy laws written a generation ago are ambiguous at best. On Friday, the first federal appeals court to consider the topic will hear oral arguments (PDF) in a case that could establish new standards for locating wireless devices.



In that case, the Obama administration has argued that warrantless tracking is permitted because Americans enjoy no "reasonable expectation of privacy" in their--or at least their cell phones'--whereabouts. U.S. Department of Justice lawyers say that "a customer's Fourth Amendment rights are not violated when the phone company reveals to the government its own records" that show where a mobile device placed and received calls.

Yeah good ol O administration protecting our civil liberties. isn't nice to feel that hope and change. Now we can wonder who the hell is listening in when we talk on our cell phones. I am tired of the FBI/CIA. it is never enough for them. They would implant tracking chips in the population if they could get away with it.

These agencies need to be reigned in pronto.

The vast majority on the left don't care -- if they did Obama wouldn't have gotten the Democratic nomination after voting for the Patriot Act and for illegal NSA wiretaps.

Civil libertarians have tried to fight this legally, but have failed. The best way to fight this now is to individually try to circumvent this crap. Get prepaid phones, use TOR when browsing the web, use TrueCrypt for encryption, use PGP, Zfone, etc.

You hadn't thought much about the false left/right paradigm then.

All the libs around here thought I was insane for talking about Obama being a warhawk and against civil liberties. They wouldn't even listen. It doesn't matter how he votes or what he does, the media is literally a propaganda machine... ALL of it.

You'd think they would think I was sane now.. but no.. most of them are a bunch of sheep like most of the Republicans.
