Tennessee State Guard commander Richard Hamblen said it's his Second Amendment right as part of a militia to convert assault rifles into fully automatic weapons. The Sixth US Circuit Court of Appeals disagreed.

Of course, can't have the people be armed. That would undermine the authority of the government.

Richard I hope you win, for all of us. I have no faith however, that an arm of the Government will rule against the Government. It has a lousy track record. I wonder how many of our rights will be trampled before we stand up.

I'm not really surprised by that ruling, but am disappointed. The Appeals courts seem to be the most leftist of the system.

The only real hope is that the SCOTUS will apply the standard set in Miller - as this ruling would overturn the Miller decision.

The other item to be noted is that state defense forces are in reality unarmed.

This case is vital because it goes to the guts of a militia and the NFA of 1934. If the NFA is not overturned, the 2A has no meaning.

If there is any silver lining to this it's that the story is finally getting some coverage. We have to do what we can to make sure it gets more.

Please, if you know him give him this info.

You can't walk into "their" court as a subject class, 2nd class citizen and expect them to rule like you are one of the free American People. And under law you aren't truly free just by saying "I think I am", you have to act the part and be one of the free People, the sovereign People.

Actually, this is point 5 of our petition for writ. The Constitution limits the jurisdiction of the federal government over the Militia in I.8.15&16

If there is any silver lining to this it's that the story is finally getting some coverage. We have to do what we can to make sure it gets more.I am so disgusted with our Country!!!! This is all complete outrage, and the people in the Regime should be ashamed of themselves, but they won't be, because all they want is complete domination. They whittle away at our rights a bit at a time until there are none. I call for a complete revision of government personnel. Vote out your city politicians, your senators and governors, judges, police chiefs and sherriffs, EVERYONE. File the caveat that any politician that does not strictly uphold the constitution on its face and not some hackneyed "interperetation" of it WILL be answered with a vote of non-confidence in the next election. Unobstructed and unfettered application of the Constitution is the ONLY way, People!!! We CAN enforce it if we have the will! We can MAKE "Them" comply, because they are more concerned with their careers in politics than anything else, so go after them where it hurts! Any candidate anywhere that does not have a strict adherence policy for the US Constitution should be put on notice that their introduced measures and legislation WILL be voted down while they are in office, and any monies requested for ANY reason other than strict adherence ones will be denied to them. Everyone is up in arms about RP and I applaud that, but we should have been acting locally LONG before this. I have been preaching this gospel to our local voting public for years, and have been labelled a "Crazy, Fringey Guy". The SCOTUS should be polled and any Justice that does not have a STRICT adherence policy on the FACE of the Constitution should be impeached. Every Congressman, Senator, and Representative should be polled and any that do not have a STRICT adherence policy should be removed from office as soon as possible. This has to become bigger than Dr Paul (who has my undying and complete respect and support), and it has to be made viral across the entire fabric of our polititcal system. Lets REALLY show our stars and stripes and act cohesively as a UNIFIED and free country...Amen.

There is only one group of gun-nutters in the United States known to regularly kill people with machine guns: the US Department of Defense. Take THEIR guns away BEFORE taking away any guns from the trustworthy US militia who can manage keep them self under control and not go on a crazy shooting rampage like the US Army and US Marines do on a regular basis.
