UPDATE (12/08/09): Devvy Kidd says that she spoke with Mr. Donofrio about this. In a December 7th article at http://www.devvy.com/new_site/chrysler_120709.html she provides details on what she found out. Some of the key points include that there are three aspects of the quo warranto statute(s) that they may use: one challenging Obama's eligibility, one challenging the legality of Obama's expenditure of funds which affected the auto dealers, and one challenging the legality of the government taking a corporate action against the auto dealers without authorized legal force. However, Mr. Donofrio emphasizes that the legal team must act in the best interests of the clients; that theoretically could mean settling the case.

A key element that has been discussed in the Obama eligibility issue has been the quo warranto provisions of the Washington D.C. code. Quo warranto is a challenge to the legitimacy of an office holder who is believed to be a usurper.

Attorney Leo Donofrio had filed a case against Obama while he was still a candidate. It was reviewed by the U.S. Supreme Court, which decided not to hear the case. Attorney Stephen Pidgeon has also been involved in attempt(s) to litigate the issue. Mr. Pidgeon's website is http://stephenpidgeon.com/

He essentially stated that quo warranto was the only way to judicially challenge Obama's eligibility now that he is sworn in. However, as I believe that he had mentioned before there has to be someone who has standing to bring the action in accordance with the statute and judicial precedent.

Then, on December 5th, Phil at The Right Side of Life made a post at http://www.therightsideoflife.com/2009/12/06/source-donofrio-pidgeon-and-quo-warranto-in-dc/ discussing an unconfirmed report by Portland Civil Rights Examiner Dianna Cotter at http://www.examiner.com/x-7715-Portland-Civil-Rights-Examiner~y2009m12d5-Cars-quo-warranto-and-Obama that Mr. Donofrio and Mr. Pidgeon were teaming up with automotive dealers who lost their businesses as a result of government takeover of the auto industry in order to both dispute the decision affecting their dealerships and also to bring quo warranto challenging the very legitimacy of the Obama administration.

Based on what I've read of Leo Donofrio's writings, I'm guessing that they probably aren't even going to bring up the birth certificate issue. They will almost certainly focus on Obama's British citizenship at birth, which is a fact not even in dispute.
