Vergennes Police Chief Michael Lowe faces embezzlement, neglect of duty and drug charges, but that's not why he is scheduled to appear in court Monday.

Vermont State Police charged Lowe last month with driving under the influence after a June incident in which he drove his cruiser into a parked car. He is scheduled to be arraigned on the DUI charge in court Monday, but it is unclear of he plans to appear.

In a news release issued Friday afternoon by Assistant District Attorney John Treadwell, Lowe is accused of five charges; embezzlement by a public official, neglect of duty, possession of a depressant, stimulant or narcotic drug and two counts of obtaining a prescription by fraud or deceit.

He is scheduled to appear in Vermont District Court in Middlebury Aug. 24 at 12:30 p.m. to face the charges.

Vermont State Police charged Lowe with DUI last month after toxicology tests detected prescription medication in his system, police said.

In a June news conference, state police said Lowe was showing signs of impairment at the time of the crash and admitted to police he was taking prescription drugs that were prescribed to him.

Police said they processed Lowe for DUI at the time, but did not charge him pending toxicology results. Police said they wanted to know if Lowe was taking the drugs within prescribed limits.

Lowe was off duty and turning onto Park Street from Maple Street when his cruiser hit the left rear end of the parked car, police said. The parked car was unoccupied, and Lowe was uninjured.

Lowe acknowledged in May that there were shortcomings in his department's record-keeping regarding whether he and other members of his department had completed the firearms and first aid training courses needed to stay certified as law enforcement officers.

What the hell difference does it make if he had dosed himself properly? He was still driving under the influence. Is that a witch hunt, or is that their idea of how to get their own off of the charge?
