Not so. Kennedy has barely been to any proceedings. Without him there, and he is not expected to be, they only have 59. Same thing with Byrd. If both of them are absent, that is only 58. The Democrats won't push forward without at least 61. The reason is that if they only have 60, one could easily switch and cloture could fail. That would make the Democrats/Obama look terrible and the bill would be lost.

I thought they needed a full two-thirds for cloture. Do you really think there would be a filibuster? I guess if actual conservatives in the Senate, like De Mint, are willing to build a team who will filibuster, then that could stop it. But would they??
