I’ve just gotten off the phone with several Florida legislative people and am happy to report that the first steps towards restoring the 10th Amendment in our state have been taken. Florida State Represenatives Workman and Plakon, along with co-sponsors Dorworth, Eisnaugle, Kelly, Precourt, and Tobia introduced House Memorial 19 (HM19), which “Urges Congress to honor provisions of U. S. Constitution & U. S. Supreme Court case law which limit scope & exercise of federal power.”
What This Means And Doesn’t Mean
It doesn’t mean that the Federal government staff and various minions are packing up. They have not started to request moving vans destined for Washington, D.C.
Here’s the bottom line:
This is a ‘Memorial’ as opposed to a ‘resolution’. Resolutions are for things like ‘key lime pie is the state pie of Florida.’ Resolutions also stay within the state level of documents. Memorials on the other hand are passed on to the national level. For instance this one (if passed) will be handed over to all of our US Congressman and Senators from Florida, who in turn request that the Executive branch (read: President Obama) start obeying the 10th Amendment and stop overreaching into state affairs.
It also means that we have an official filing in the Florida State House Legislature docket. Now we can start calling all of our State House Representatives and ask them to sign on as ‘co-sponsors’ of House Memorial 19 (HM19). If we can get enough co-sponsors we can win probably win passage on the first day of the Legislature meets in March 2010.
You may wonder why Representatives Workman and Plakon got this resolution together so early. It has to do with the way the legislature does its work. Documents with lower numbers like HM 19 are not as likely to get lost in the shuffle as HM 7019 (the numbers of items do actually get this high as the session nears). This early start allows us time to start the lobbying effort required to pass it.
The opposition will most likely come from Democrats and Republicans that are misinformed about the nature of HM19. We need to tell them that the Federal branch is in breach of their constitutionally mandated limits. This is the first step that will remind D.C. bureaucrats that we the people are watching. We want to put a stop to this infringement of our rights.
What To Do Now!!!
Please first find out who your Florida State House Representative and Florida State Senator is. This is easy to do by going to

If you don’t know your four digit code that goes with your zip code, just pick up a piece of commercial mail it will usually have it on the end. In closing, this is a very exciting development. One of the reasons that the representatives created this ‘memorial’ so early was to coincide with our 4th of July holiday. No better present could be given to Florida citizens! But our work has just begun.
