I did not see him say that he would not confiscate firearms from citizens, only that no body has the authority to issue that order or maybe I just read this all wrong.

LOL true enough. The bigger point, I think, is that nobody anywhere has the authority to tell a Sheriff to do...well anything really. I am guessing the author includes the Sheriff's department as 'not having the authority' to issue orders to confiscate.

But you are right, it looks like he very carefully avoided saying that he would not confiscate. Just that nobody had the authority to order him to confiscate.

Mind you, nobody has the authority to order him to arrest a serial killer either...

BTW, OP: if you weren't on somebodies list before....you are now!

OP... I would send another letter and ask about firearm confiscation again. I would be friendly about it because he could have just overlooked it but he really did not answer the question.

At least local Sheriffs do have that accountability factor. But, I suppose if you live in an ultra liberal county, then, if 51% of the people wanted to snatch up all the guns, you'd be SOL. (because we know the Constitution doesn't mean anything if you have a majority, unfortunately :().

Good job to the OP for taking the time to put this together.

Wow, very impressive!

I think a followup pinning the sheriff down on the issue of gun confiscation being a violation of the Constitution would be fantastic. It's sad that, in our current environment, asking a question like that would be very nervy.

It's right there.
This person admitted that THEY (the sheriff ) do not have the authority to do so either.
They affirmed the oath to protect the constitution as well.

Not too bad.

oh hell, I was hoping you heard back after pressing the "but WILL you do it if someone orders you, whether they have that authority or not, or WILL you confiscate arms if the order comes from within the Sheriff's department?" issue.

Yeah, I don't think I am going to push them, I am considering sending a similar version to the police dept tho to see how their response compares to the Sheriff's...

The problem I have is the part where he discusses registration of firearms.

By that statement he affirms that he believes that there are people who have the authority to confiscate UNregistered firearms from law-abiding citizens.
