View Full Version : Will Tea Party Participants put the squeeze on Congress?

A few weeks ago Judge Napolitano was on the Glenn Beck talk radio show and stated we need to “starve” the federal government by ending the income tax. Judge Napolitano was absolutely correctly about ending the income tax which has placed far too much power in the hands of folks in government and is a taxing system which actually encourages a significant amount of the evil on Capitol Hill we, as a nation, now experience. It allows members of Congress to determine who will and who will not bear the burden of taxation, and so, countless groups have formed which wine and dine and bribe members of Congress to be exempt from federal taxation. This of course does not even take into account how sleazy power crazed progressive members of Congress, and now our President, use the income tax system to engage in class warfare and build a captive voting block to keep themselves in power. This was Obama’s primary game plan used to win the election ___ panhandling an end to taxes for an identifiable 95 percent of Americans, when in fact 40 percent of Obama’s 95 percent were not paying taxes on incomes but ran to the polls to elect what has turned out to be nothing more a slick talking flimflamming con artist! And so, ending the “income tax”, which has proven to be a venomous poison of corruption, would go a long way in Tea Party Participants taking back their country. But the question is, how should Tea Party participants accomplish the goal?

Article V of our federal Constitution gives two options for change --- calling for a constitutional convention for proposing amendments to our constitution or, having two thirds of both Houses of Congress propose a specific amendment or amendments to the States for ratification. The problem with the first method [calling for a constitutional convention] is that everything is up for grabs which James Madison cautions against in the following manner:



… an election into it would be courted by the most violent partizans on both sides; it wd. probably consist of the most heterogeneous characters; would be the very focus of that flame which has already too much heated men of all parties; would no doubt contain individuals of insidious views, who under the mask of seeking alterations popular in some parts but inadmissible in other parts of the Union might have a dangerous opportunity of sapping the very foundationsof the fabric ___ See Letters of Delegates to Congress: Volume 25 March 1, 1788-December 31, 1789, James Madison to George Turnersville

The second course of action is the safest route but requires a diligent and active participation by the people in which they rise up and demand their specific members of Congress to adopt a resolution in Congress for sending the desired amendment to the states for ratification. The second route also has a very important advantage! It forces every member of Congress to take a YEA or NAY stand on a specific issue . . . sending the desired amendment to the states for ratification. Unlike calling for a constitutional convention in which the people ask their state Legislatures to call upon Congress to convene a constitutional convention, the end result of which is nothing more than a crap shoot, the single amendment route actually defines a specific goal supported by the people at large and puts every member of the House on the spot with the people’s wrath surely to be felt during election time and would be within a two year period. Currently, that would be in 2010, which is just around the corner!

So, let us look at history and how the people obtained the repeal of the 18th Amendment [prohibition]. Click HERE (http://www.albany.edu/~wm731882/21st_amendment_final.html) and see how the people rose up and demanded their “beer” and how the 21st Amendment [ending prohibition] came to be. All that was necessary was for the people of each state to rise up and demand their State’s members of Congress to introduce the necessary resolution to send the 21st Amendment to the States for ratification!

Keep in mind the so called “equal rights amendment” was almost approved as part of our Constitution but the last state to ratify missed the deadline because there was not enough popular support for the amendment to be adopted. But, the same strategy used by ERA supporters can and should be adopted by Tea Party Participants….demonstrations, picketing, writing letters to the editor, radio and TV talk shows, a constant barrage of emails and letters to each State’s members of Congress demanding them to adopt a resolution in Congress for sending the appropriate amendment to the states for ratification.

The important thing to remember is, ending the income tax has an approval rating among America’s domestic business owners and working class people of about 70 to 80 percent, and if a particular member of Congress refuses to adopt the necessary resolution to send the appropriate amendment to the states for ratification, they can expect to be replaced in 2010 with someone who will carry out the people’s instructions!

Glenn Beck, Judge Napolitano and every Tea Party organizer ought to be encouraging Tea Party Participant to start a campaign demanding Congress to send to the states for ratification a Constitutional Amendment providing that:

The Sixteenth Amendment is hereby repealed and Congress is henceforth forbidden to lay ``any`` tax or burden calculated from profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money

This would bring us back to our Constitution’s original tax plan, imposts, duties, and miscellaneous excise taxes on articles of consumption, and, a direct apportioned tax if Congress borrows to meet expenses which is a built in method to balance the budget and would make every member of Congress immediately accountable to their State Governor and Legislature if Congress borrows to meet its expenses which in turn requires them to bring home a bill for their State‘s apportioned share in extinguishing the deficit Congress has created!

Picture for a moment the expression on the faces of the Governor of New York and the New York State Legislature if New York should receive a bill from Sen. Chucky-boy-Schumer for New York’s apportioned share to extinguish the 2009 federal deficit which Chucky helped to create with his teeny, tiny pork barrel earmarks which he alleges Tea Party Participants do not care about! I suspect they would great him at the border of N.Y with tar and feather parties, instead of tea parties as they rightfully should!
