Has anyone on here discussed the new Montana gun law?

Glenn Beck, Judge Napolitano, Kevin Gutzman, and the state legislator who drafted it were on a special show on Fox last Saturday.

Essentially the law says that any gun completely manufactured in Montana, and has the label "made in Montana" does NOT fall under the jurisdiction of the United States and thus one does not have to apply for a permit to own, carry, conceal, etc!!!! :D

From the bill:

"A personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in Montana and that remains within the borders of Montana is not subject to federal law or federal regulation, including registration, under the authority of congress to regulate interstate commerce. It is declared by the legislature that those items have not traveled in interstate commerce."


and

"The authority of congress to regulate interstate commerce in basic materials does not include authority to regulate firearms, firearms accessories, and ammunition made in Montana from those materials. Firearms accessories that are imported into Montana from another state and that are subject to federal regulation as being in interstate commerce do not subject a firearm to federal regulation under interstate commerce because they are attached to or used in conjunction with a firearm in Montana."

The better news, now other states are jumpig on the bandwagon.

Alaska has a similar bill pending and I'm lobbying my NH reps, hard, to do the same thing here.

I don't have much hope that the Texas bill will pass, for all the talk, Texas is rapidly becoming a "center nation New Jersey".

I could see it passing in Alaska long before Texas.

Well, it isn't specifically about gun rights, but more about state sovereignty.


These three resolutions are:

2009 House Concurrent Resolution 4 - to affirm Michigan's sovereignty under the Tenth Amendment to the Constitution of the United States and to urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.

* Referred to the House Government Operations Committee on January 22, 2009.

2009 House Concurrent Resolution 5 - to request the State Officers Compensation Commission to recommend a 10 percent legislative salary reduction and to endorse and follow certain performance-based pay structures.

* Referred to the House Government Operations Committee on January 22, 2009.


2009 House Concurrent Resolution 6 - to memorialize the President, the Congress, and the Department of Homeland Security of the United States to change requirements, agreements, and memorandums of understanding relating to the creation of Enhanced Drivers Licenses.

* Referred to the House Transportation Committee on January 22, 2009.

How can we start putting forth a proposal like this in every state?
Well - first and foremost meet with your State legislators. Then get your friends to do the same. Then get the GOA and NRA groups to also do the same.

I just e-mailed the State Reps and Senators that would most likely be interested in introducing something like this in our legislature.

Oh, ok, still good news.

I know about 25 states had pending or introduced bills reclaiming 10th amendment sovereignty.

Good for Michigan.
