If Ron Paul was president right now, who do you think he would try to appoint to take Souter's spot?

Think he'd give Napolitano the nod?

Of course RP would give Andrew Napolitano the go ahead. I could also see Kevin Gutzman getting nominated.

I would hope Napolitano if he wasn't rejected by the statists that control the Judiciary Committee, if it was to replace Ginsburg,people would be screaming, "Oh we need a woman" or if it was Clarence Thomas,"Oh,we need another African American or whatever, Constitution be damned!

It would be a wonderful event if Judge Napolitano were appointed to the Supreme Court. And hey, if we get Dr. Paul for president in 2012, it might happen...

I would actually bet Bruce Fein would be far more likely (except that he might also be the attorney general of the Paul administration). The other choice would likely be that they find some Constitutional law Professor from somewhere like Yale, Harvard, or Princeton who has big time stict constructionist/small government beliefs.
Like I said, I think Fein and Napolitano would already be part of the administration and therefore either would be seen as a political/nepotism pick. But between the three of them they would find someone great (I believe Bruce Fein was in of the Scalia and Anthony Kennedy choices, who are probably my two favorite standing justices).

I'll second Fein. I just watched his April address to the FFF and was thinking he would be a great justice.
