Please feel free to modify and use at will. This passed unanimously at the Franklin County NC Republican Convention; and mirrors a bill recently submitted to the NC State House.




RESTORE NORTH CAROLINA STATE SOVEREIGNTY

WHEREAS, the Ninth Amendment to the Constitution of the United States prohibits the federal government from abusing those rights of American people which have not been enumerated in the Constitution or Bill of Rights; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being specifically that granted by the Constitution of the United States and no more; and

WHEREAS, the scope of power defined by the Ninth and Tenth Amendments means that the federal government was created by the states specifically to be an agent of the states, and of the people respectively; and

WHEREAS, today, in 2009, the states and the people are demonstrably treated as agents of the federal government; and

WHEREAS, many powers assumed by the federal government and federal mandates are directly in violation of the Ninth and Tenth Amendments to the Constitution of the United States; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and

WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States; now, therefore,

SO BE IT RESOLVED, BY THE FRANKLIN COUNTY REPUBLICAN PARTY OF THE STATE OF NORTH CAROLINA,

IN ACCORD, that we hereby affirm North Carolina and her citizen's sovereignty under the Ninth and the Tenth Amendments to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. We also demand that the federal government halt and reverse its practice of assuming powers and of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.

A RESOLUTION OF THE FRANKLIN COUNTY REPUBLICAN PARTY OF NORTH CAROLINA AFFIRMING THE RIGHTS OF THE CITIZENS OF NORTH CAROLINA TO KEEP AND BEAR ARMS, AND PROTECTING THOSE RIGHTS AGAINST INFRINGEMENT FROM FEDERAL LEGISLATION AND EXECUTIVE ORDERS.

WHEREAS, the Second Amendment actively prohibits the Federal Government from infringing upon the people's right to bear arms, and

WHEREAS, the Federalist Papers (specifically Madison #46 and Hamilton #29) as well as the history of the ratification of the Second Amendment reveals that the right to bear arms was intended as a hedge against Federal Government tyranny, and

WHEREAS, a right specifically enumerated as a hedge against the potential tyranny of the Federal Government ought to be subject neither to the definition by, nor to the legislation of the Federal Government, and

WHEREAS, the presiding officers of the Executive Branch have clearly and openly stated their intent to reimpose the ban on semiautomatic rifles under the misnamed "Assault Weapons Ban," and further to make this ban permanent, and

WHEREAS, the Tenth Amendment to the US Constitution denies the Federal Government from assuming any powers not specifically delegated to it by the US Constitution, and

WHEREAS, Article 1, section 30 of the North Carolina Constitution and Declaration of Rights specifically guarantees to North Carolina citizens the right to bear arms as protection against the standing armies of the Federal Government, and

WHEREAS, any legislative attempts on the part of the Federal Government to ban weapons based on criteria of form or function violates both the writ and the intent of the founding documents of our nation and our state, and are thus invalid and therefore void,

THEREFORE LET IT BE RESOLVED, that we, the people of the Franklin County Republican Party of North Carolina reject any intent upon the part of the Federal Government to ban weapons based on cosmetic form or method of function, and

that we, the people of the Franklin County Republican Party of North Carolina refuse to be subject to the unconstitutional tyranny of the Federal Government, and

that we, the people of the Franklin County Republican Party of North Carolina will actively dedicate ourselves to nominating and electing representatives to the North Carolina State Assembly who will draft and pass legislation rejecting said measures and protecting the rights of the citizens of our state,

THEREFORE LET IT BE FURTHER RESOLVED, that we, the people of the Franklin County Republican Party of North Carolina do hereby call upon the members of the North Carolina General Assembly to immediately pass legislation rejecting Federal weapons bans, asserting our State sovereignty under the 10th Amendment, and refusing compliance with any and all weapons bans at the Federal level.

and given the two above so-passed resolutions in the body,

We as a delegation pledge our support for North Carolina House Bill 849, “supporting the state’s right to claim sovereignty over certain powers under the Tenth Amendment to the Constitution of the United States.” ...

BE IT FURTHER RESOLVED, that the duly elected Secretary of the Vance County North Carolina Republican Party be instructed to prepare a properly inscribed copy of this resolution for the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Governor of the State of North Carolina, both of the United States Senators from North Carolina, the United States House Representatives from North Carolina's 1st and 2nd Districts, the President of the North Carolina Senate, the Speaker of the North Carolina House of Representatives, the entire House and Senate delegation serving Vance County, the Chairman of the Republican National Committee, and the incoming Chairman of the North Carolina Republican Party.

Bump, everyone who can use this, should. Sovereignty has become the bridge between Paulers and Republicans in NC, and making almost Blistering progress!
