This is really a question on why the government gets away with it.

Simplest answer is they are master propagandists.

IN a contractual relationship, the parties of the contract are responsible for the enforcement of the contract.
In the federal contract, the states and the people of the states are not enforcing the agreement, so the clowns in DC's only limit is anything they can't get away with...

I set up a poll on this question in another thread. I was orginally supposed to do it here but messed up.

The states don't enforce the contract because the civil war made them subservient to the federal authority and announced that the federal judiciary alone is the final say on constitutionality.

As for the people, the whole idea that this is a democracy where majority wants majority gets despite rule of law which prevents encroachment upon things is what keeps the people voting in politicians who offer the most free handouts. Why do you think FDR was the only president ever to be elected more than 2 terms. His popularity and willingness to give out free shit during his administration created what the Anti-federalists basically called and rightfully feared an elective monarchy.

People don't care because they get free stuff and the states are powerless to do anything about it... either that or the states like their bribes for highway funds so that keeps them shut up.

'Lysander Spooner once said that he believed "that by false interpretations, and naked usurpations, the government has been made in practice a very widely, and almost wholly, different thing from what the Constitution itself purports to authorize." At the same time, he could not exonerate the Constitution, for it "has either authorized such a government as we have had, or has been powerless to prevent it. In either case, it is unfit to exist." It is hard to argue with that.' -- Thomas E. Woods Jr

You have both major parties that have held a monopoly on our political process for 175 years and both have been big government interventionists;albeit from different points of view; for at least 75 years and most trust "their" side to do the right thing. The Democrats use the children ,humility and fairness to push their agenda and the Republicans use security, national defense and spreading democracy to push theirs. Between the two, there isn't a damn Clause,Amendment or Right safe from these statists.

Experience hath shewn, that even under the best forms of government those entrusted with power have, in time, and by slow operations, perverted it into tyranny.
