Affirming that the State of Texas claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the U.S. Constitution, serving notice to the federal government to cease and desist certain mandates, and providing that certain federal legislation be prohibited or repealed.

Go Texas! I love these states asserting their rights. We are a REPUBLIC. A voluntary union.

I commend every state who even manages to introduce such legislation.

Apparently, Texas language of this bill is the most assertive out of all the bills in the 21 states thus far. It means they really mean what they say, not just trying to sugar coat something.

I will move there in a heart beat. With enough freedom loving people in one state it would quickly become the premier state to live in.

Just got off the phone with my state rep's office.

She said she's been getting emails for two days on this.

I asked if the emails were for or against.

She said every one of them is FOR it.

If you live in Texas, CALL YOUR STATE REP NOW and tell them you support this bill!

They DO keep a tally and that DOES influence their vote! (or so they claim ;))

This is a good sign.
Imagine if the U.S. broke off into several different countries.
While I don't agree with the IDEA of government, we would then be moving to the model described in the book The Sovereign Individual, written in 1997, where governments would actually SERVE people and compete for citizens based on what they had to offer, how low their taxes were, etc.

So it's possible that someday we get to a point where we have choices at least. Maybe the northeast is the high tax/lots of socialized services area, and maybe texas becomes low or no taxes, with a thriving free market.

It's still not my preference of anarcho-captialism, but as long as we are free to move around (that's a big if), it's much better than what we have today.

I'm certain DC is keeping tabs on these state governments.

Hopefully DC is starting to understand that it's power comes from the people. Hopefully they have noticed these resolutions and hopefully they have noticed people's tendency to buy guns and ammo.

We still live in America, land of the free. The people are simply starting to assert their rights to self government and individual rights. Makes me proud to be an American when I see our people doing these things.

Its a good first step, but what will it do other than "declare" something that is already printed. Will there be action? A followup bill that says "because of this declaration" we arent acknowledging this Federal Mandate"?

CONCURRENT RESOLUTION
WHEREAS, The Tenth Amendment to the Constitution of the
United States reads as follows: "The powers not delegated to the
United States by the Constitution, nor prohibited by it to the
States, are reserved to the States respectively, or to the people";
and
WHEREAS, The Tenth Amendment defines the total scope of
federal power as being that specifically granted by the
Constitution of the United States and no more; and
WHEREAS, The scope of power defined by the Tenth Amendment
means that the federal government was created by the states
specifically to be an agent of the states; and
WHEREAS, Today, in 2009, the states are demonstrably treated
as agents of the federal government; and
WHEREAS, Many federal laws are directly in violation of the
Tenth Amendment to the Constitution of the United States; and
WHEREAS, The Tenth Amendment assures that we, the people of
the United States of America and each sovereign state in the Union
of States, now have, and have always had, rights the federal
government may not usurp; and
WHEREAS, Section 4, Article IV, of the Constitution says,
"The United States shall guarantee to every State in this Union a
Republican Form of Government," and the Ninth Amendment states that
"The enumeration in the Constitution, of certain rights, shall not
be construed to deny or disparage others retained by the people";

WHEREAS, The United States Supreme Court has ruled in New
York v. United States, 112 S. Ct. 2408 (1992), that congress may not
simply commandeer the legislative and regulatory processes of the
states; and
WHEREAS, A number of proposals from previous administrations
and some now pending from the present administration and from
congress may further violate the Constitution of the United States;
now, therefore, be it
RESOLVED, That the 81st Legislature of the State of Texas
hereby claim sovereignty under the Tenth Amendment to the
Constitution of the United States over all powers not otherwise
enumerated and granted to the federal government by the
Constitution of the United States; and, be it further
RESOLVED, That this serve as notice and demand to the federal
government, as our agent, to cease and desist, effective
immediately, mandates that are beyond the scope of these
constitutionally delegated powers; and, be it further
RESOLVED, That all compulsory federal legislation that
directs states to comply under threat of civil or criminal
penalties or sanctions or that requires states to pass legislation
or lose federal funding be prohibited or repealed; and, be it
further
RESOLVED, That the Texas secretary of state forward official
copies of this resolution to the president of the United States, to
the speaker of the house of representatives and the president of the
senate of the United States Congress, and to all the members of the

Texas delegation to the congress with the request that this
resolution be officially entered in the Congressional Record as a
memorial to the Congress of the United States of America.

Everybody blends in in Houston.

There was a thing on the radio about the 'slave traders' that bring illegals into Houston etc etc. The whole premise was that Houston is such a melting pot that nobody stands out

Texas is my country.

Our Union, the United States of America is not a country in the traditional sense. It is a group of 50 separate countries (states) which follow a common charter, The US Constitution. So long as the states do not violate this charter they may conduct business in their state in whatever manner they see fit.

The federal government is meant to do nothing more than enforce the regulations set forth in the US Constitution, but after 2 centuries I’m afraid we have drifted far off the Founding Father’s original mark. The federal government is now a bloated entity filled with bureaucracy and greed. Without swift action our Union will never return to its former glory.

My country (state) is Texas. It was where I was born and I still spend the majority of my time there. I wave its flag with more pride than the flag which represents the United States.

I am a Texan first and an American second.

Fellow Texans this is a great day.

All of Houston, although I niche market West Houston and Katy. I'm licensed in all of Texas but that's right on the state line.

You'd be best off contacting an experienced agent in the area. I could refer your name and number to someone up there and get a small referral fee out of it if you purchased property. :)
