With the new info that the NSA was going through everyone's phone, data, & credit card
transactions; is it possible for the public to sue the government in a class action lawsuit
over the violations of their constitutional rights?

I fixed your post. There's no such thing as "constitutional rights". That phrase irks me. There are only innate rights. You should check out Badnarik's Constitution Class.

But I like your idea.

The answer to that question is always yes. Successfully or not is another question. ;)
