Hokay, I know this is probably rehashed stuff, but the Department of Education?? Really??? I can at least get a default Interstate Commerce clause argument for the FDA or ICC, but honestly, where the FUCK does it say or even imply Congress can create the Department of Education?

lol yeah it's sad that argument could be inferred by people...like the Supreme Court..how would the logic look for that??

Education -> gives you knowledge -> gives you a piece of paper, a title, and hat -> you can get a job -> that job may be for a company who sells chairs -> because the chair market is especially prevalent in California and New Jersey, your job impacts apparently the entire economy -> therefore, attending a Community College gives you the tools to become economic dictator and we must regulate how exactly you are to obtain that education or at least control the subject matter.

It's sad because this was very similar to that Wickard v. Filburn case. The guy produced like 230 bushels extra of corn to provide for his family and the Supreme Court declared that interfered with interstate commerce because it impacted the entire food market so therefore the federal government could enforce quotas. And to think these dipshits went to law school.

Seriously, the interstate commerce argument is not only a bunch of bullshit, but where the fuck does it stop?? If the government can tell you whether or not you can feed your family on your own, why exactly can't they regulate your life then? If you are to ever buy candy out of a candy machine or get a job, you impact interstate commerce in one fucking way or another. Thanks to Adam Smith, we know a candy bar and its packaging are not all produced, distributed, and consumed all in the same state.

It stops when they try to enforce gun laws around schools because it effects interstate commerce, because it leads to a fearful learning environment. That is the only limitation the Almighty Supreme Court has found in the Interstate Commerce clause. Douches.

You nailed the argument. They used the same argument for the gun free school act. If guns are around schools the kids can't concentrate, if they can't concentrate they can't get a good job which will affect interstate commerce! The supreme court found it unconstitutional, but that didn't stop them from passing it a couple years later.

No department was actually in the Constitution. The Constitution suggests a bunch of advisors who have to report the the prez every so often. Washington saw it as unworkable and made a similar thing in the cabinet. Originals were Secretaries of War(Defense), Treasury, and State. By the end of his presidency, the Justice Department was also made.

More were added and divided over time.

They abuse and extend the General Welfare Clause to mean they can do whatever they want that they can pretend is for our own good.
