HOUSE JOINT
RESOLUTION 1089 By: Key
AS INTRODUCED

A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution.

WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows:

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and

WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the
states; and

WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States.

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:

THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.

THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated
powers.

THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

Yes! Let's get this out to all VA meetups as well. We can push this!

Maybe a statewide petition drive? Get all the meetups to get sigs and present that to the state legislature?

was it just Introduced for a vote or actually voted into law??

It was passed by the OK House of Reps by a vote of 92-3. However, this is just a resolution and not necessarily that meaningful in the whole scope of things. Hopefully it will lead to an actual law, but I wouldn't hold my breath. :o

They SHOULD make this a "law" BY passing a constitutional amendment saying "the US Senator's from the State of Olkahoma Shall be chosen by us the Legislature"

I'm not sure what they are trying to accomplish. They already can exercise those rights by evidence of the Federal and State Constitutions.

If they don't like Federal bureaucrats meddling in affairs not granted to it by the Constitution, then stop accepting Federal funding for the various programs and projects. That is usually the nexus that gets the Fed. involved.

California should do the same thing and then when the feds come in and bust up a medial marijuana shop, they should declare it an act of war against a sovereign state.

It doesn't matter. The feds will send soldiers and you'll have a mini civil war on your hands. They are willing to kill thousands of citizens just to survive.

Quite possibly. But it will only be because our fellow countrymen care more about preserving their "right" to mooch off of everyone else via govt force than they care about letting their children live in freedom. You know, the hypocrits who seem to think that the only individual rights we need to protect are those that are PC.

As compared to the 350k+ that the Union had? If anything, the Union got slaughtered. The South had the better generals and better soldiers too :)

The people of this state have the sole and exclusive right of governing themselves as a free and sovereign state; and do, and forever hereafter shall, exercise and enjoy every power, jurisdiction, and right, pertaining thereto, which is not, or may not hereafter be, by them expressly delegated to the United States of America in congress assembled.

Acts 1997, No. 1494, §1, approved Oct. 3, 1998, eff. Nov. 5, 1998.

By arguing legal precedence, we substantiate legal precedence over the Civil Purpose in the Constitution.
