The crime is theft by deception. The victim is the bank where he used the Matching funds to secure a 4 million loan.

Representatives and share holders of the bank can file a complaint with the local police. By law the police must issue a warrant for his arrest.



There are also other victims in this. The people of the states where he deceived the State election officials to think he had matching funds to pay for the State fees for ballot access.

People in these states can file multiple complaints on a multiple or single complaint basis to charge McCain with theft of services because he used the promise of matching funds to secure ballot access.

How do you find out which states he paid to get on the ballot? Is there a site where one can research?

Some point of clarifications:

1) I don't know (and strongly doubt) if stakeholders can act on a bank (or any corporations)'s behalf. More likely, this has to be handled by the CEO/board of directors, and I wouldn't bank on it.

2) In some cases, such as Ohio, McCain only had to show that he was eligible for funding, not to actually accept the funds, so no laws were broken.


I'd much rather that we concentrate on the fact that he went over the spending cap because this is a bona fide, clear cut infraction and we have numbers to show it, and the letter from FEC telling him that he couldn't withdraw.

I quite understand that, but the most helpful thing we can do is to make sure we have a solid case, and we have the luxury of choosing between two cases. I'd just go with spending cap only because it's more easier to present than ballot access violations, which can be problematic and easy to rebut. It's hard to argue against a spending cap broken, whereas ballot access is more complicated and they could just say, "oops my bad" and everyone would say, "oh, no big deal". JMHO.

We always have "to have a strong case" the only thing is NOTHING EVER GETS DONE. He went over spending limits, sue his ass! GET HIM OUT OF THERE

He used the matching funds, which isn't his, as security to a loan. After he got the loan approved he wants to drop the matching funds program he used as collateral. That is a felony. He falsified information to secure a loan.

Spending cap issues are easily resolved by repayment of what was overspent. No harm.

Thank you for the find on the recall petition discussion. I will sign. I think I could get a few more signers.

Too bad they don't do one for Jon Kyle at the same time. He backs up McCain on all the issues we are against.

This am. he is talking that we need to back up the Fed having control of the markets.

It would be poetic if they both were recalled.

I would leave out about the skin cancer in any petition as it is McCain's record, or should I say lack there off, that is the main issue.
