Q: Does the Department of State’s acceptance of a candidate’s nomination petition guarantee that the candidate’s name will appear on the primary ballot?

A: No. A nomination petition is deemed to be valid, unless, within seven (7) days after the deadline for filing nomination petitions, an objection petition is filed with the Commonwealth Court, which sets forth the reasons why the candidate’s nomination petition should be set aside.

Note: A copy of the objection petition must also be served on the Secretary of the Commonwealth within the same period. In addition to personal service and service by certified mail, the Secretary of the Commonwealth will accept service of process via fax at either of the following numbers: (717) 705-0721 or (717) 214-9899.
