I can understand no smoking, but "your too fat to eat here" ??

No fat people allowed: Only the slim will be allowed to dine in public!

It has actually happened. Lawmakers have proposed legislation that forbids restaurants and food establishments from serving food to anyone who is obese (as defined by the State). Under this bill, food establishments are to be monitored for compliance under the State Department of Health and violators will have their business permits revoked.

House Bill 282 was introduced in the 2008 Mississippi legislative session on Friday by Representative W.T. Mayhall, Jr., a retired pharmaceutical salesman with DuPont-Merk. Its co-authors are Bobby Shows, a businessman, and John Read, a pharmacist.

HOUSE BILL NO. 282


An act to prohibit certain food establishments from serving food to any person who is obese, based on criteria prescribed by the state department of health; to direct the department to prepare written materials that describe and explain the criteria for determining whether a person is obese and to provide those materials to the food establishments; to direct the department to monitor the food establishments for compliance with the provisions of this act; and for related purposes. Be it enacted by the legislature of the state of Mississippi:


SECTION 1.

(1) The provisions of this section shall apply to any food establishment that is required to obtain a permit from the State Department of Health under Section 41-3-15(4)(f), that operates primarily in an enclosed facility and that has five (5) or more seats for customers.

(2) Any food establishment to which this section applies shall not be allowed to serve food to any person who is obese, based on criteria prescribed by the State Department of Health after consultation with the Mississippi Council on Obesity Prevention and Management established under Section 41-101-1 or its successor. The State Department of Health shall prepare written materials that describe and explain the criteria for determining whether a person is obese, and shall provide those materials to all food establishments to which this section applies. A food establishment shall be entitled to rely on the criteria for obesity in those written materials when determining whether or not it is allowed to serve food to any person.

(3) The State Department of Health shall monitor the food establishments to which this section applies for compliance with the provisions of this section, and may revoke the permit of any food establishment that repeatedly violates the provisions of this section.


SECTION 2. This act shall take effect and be in force from and after July 1, 2008.

I cant imagine any restaurant enforcing this. Except maybe an all you can eat place if they think certain customers are unprofitable for some reason.

this is fairly obvious. the designers of this are in pharmaceuticals. stop smoking drugs and related items, now lots more weight loss drugs, and i'm sure there will be a vaccine too.

I'm from mississippi.....we have some seriously fat people..... However, i have to side with Ron Paul......it's not up to the government to legislate your body to you. Back in the day, legislators trying to pass stuff like this would have been tried for treason, and rightly so.

this is going to raise the crime rate. lots of angr people having to stay home because the are big or smoke and not lucky in changing will just find some trouble to get into.

Of course not. It sounds like you're going to have to weigh them first, measure their height, and do BMI calculations. This is far too important to just let restaurant owners eyeball it. After that, you'll probably be allowed to use more sensitive language like "portly" or "pleasantly plump."

Actually my understanding is that this bill is aimed at buffets where the business owner may not mind having the right to refuse to serve an obese person.

Back when I was a younger man I was one of those high-metabolism types who could eat a huge amount of food and never gain weight. My only saving grace at the buffet was that I never took food I didn't eat.

It disgusts me to see people loading up a plate from a buffet, eating a few bites, and leaving the rest behind, and having the audacity to go get more. They are the pigs.

I have been immobile for the past month and my BMI has crept up to 30. By this scale, I am obese. Interesting, since I'm 5"5" and 120 lbs. (I usually hover around 115, but I've gained a little weight the past month due to immobility.) I AM OBESE and I wear a size 6, sometimes a size 4, but I AM OBESE. (For those who don't understand, I have small bones.) Can't you just see it now. I go to a Fat Anonymous meeting, stand up and proclaim, "Hi. My name is Freelance, and I'm OBESE!"

I have never dropped the F-bomb, but F this crap!

The reason I am so angry about this is because this is what socialized medicine is going to do to us. They are going to require all kinds of evaluations, many of which may be dangerous and invasive, then they will then prescribe a course of action, and we will not have one thing to say about it. They'll check our blood to ensure that we're taking the meds, and if we don't, they'll find a way to make us criminally liable, just like they're doing to parents right now who refuse treatments for their kids. This is just scary as hell.

This guy in the video must have been one of the first neocons. Just listening to what he is saying and replace the word "drugs" as in the war on drugs, with "terror" so it is the war on terror.

BTW: how is that war on drugs going anyways.
