I just recieved this e-mail from my meet-up group, It sounds legit, but I guess I am possibly spreading false rumoirs. I hope not and please someone with knowledge confirm this;

Did you know the Republican Party can also exclude Ron Paul from the Republican Primary in North Carolina??

According to new state law, the Republican Party State Chairman, Linda Daves, will determine what candidates are placed on the Republican Primary ballot. She must file these names by Feb. 5.

If Ron Paul is not included, we must collect 10,000 signatures on a petition to be present before March 3rd (I think).

I believe we need to prepare ourselves right now and not wait till Feb 5th to see if Dr. Paul is “legally” excluded from the Primary.

Again, please someone say it is'nt so.
How can it be possible that one person or even the whole NC Republican Party be allowed to exclude ANY candidate that has gone through the whole process up to now?
It is bad enough that North Carolina makes it near impossible to run outside the two controlling parties, but NOW they have the right to ignore INDIVIDUAL REPUBLICAN CANDIDATES as well??

i specifically contacted the campaign on this issue and was told that "dont worry they have a team working on this and early states have priority"

as far as feb 5th list and 10,000 signatures. this is the first i heard of that. sounds crucial.
I think i will call her. i suggest you do the same.

* An individual must be a natural born citizen of the U.S., 35 years of age, and a resident of the U.S. for 14 years.

3.) How can a candidate be placed on the ballot for the presidential primary election? (§163-1, 213.4, 213.5)

By the first Tuesday in February of the year preceding the North Carolina presidential preference primary, the chair of each political party shall submit to the State Board of Elections a list of its presidential candidates to be placed on presidential preference primary ballot. The list must be compromised of candidates whose candidacy is generally advocated and recognized in the news media throughout the United States or in North Carolina, unless any such candidate executes and files with the chair of the political party an affidavit stating without qualification that the candidate is not and does not intend to become a candidate for nomination in the North Carolina Presidential Preference Primary Election.
The State Board of Elections shall prepare and publish a list of the names of the presidential candidates submitted.

* On the first Tuesday in March preceding the presidential preference primary (March 4, 2008) the State Board of Elections (SBE) will convene in Raleigh to nominate all candidates affiliated with a recognized political party pursuant to the provisions of Article 9 of Chapter 163 of the General Statutes, who have been submitted to the State Board of Elections. Immediately upon completion of these requirements, the board shall release to the news media all such nominees selected. Provided, however, nothing shall prohibit the partial selection of nominees prior to the meeting required by this section, if all provisions herein have been complied with.
* - or- Nomination by Petition -Any person seeking the endorsement by a national political party, may file with the SBE petitions signed by 10,000 qualified voters who are affiliated with the same political party as the candidate for whom the petitions are filed. Petitions must be filed with the county board of elections (CBE) by February 19, 2008, which is ten days before the filing deadline. The signatures on the petitions must be verified by the appropriate CBE and filed at the SBE by the candidate no later than 5:00 PM on the Monday prior to the date the SBE is required to meet pursuant to GS 163-213.4 preceding the presidential preference primary

4.) How are unaffiliated candidates nominated? (§163-1, §163-122, 163-209)

* A candidate who seeks to have his/her name printed on the general election ballot as an unaffiliated candidate shall file a petition with the SBE by 12:00 Noon on the last Friday in June preceding the general election, Friday, June 27, 2008. This petition must be signed by 2% of the total number of voters who voted in the most recent general election for Governor (69,734). No later than 5:00 p.m. on the fifteenth day (June 12, 2008) preceding the date petitions are due to be filed with the SBE, each petition shall be presented to the chairman of the CBE in which the signatures were gathered and verification by the chairman shall be completed within two weeks from the date the petitions are presented.
* A Presidential candidate who has qualified to have his/her name printed on the ballot as an unaffiliated candidate will nominate presidential electors. One elector from each congressional district and two from the State at-large. He or she must file this list of electors with the Secretary of State no later than 12:00 Noon on the first Friday in August - Friday, August 1, 2008.
* He or she must file the name of the vice-presidential candidate with the State Board of Elections no later than 12:00 Noon on the first Friday in August - Friday, August 1, 2008.

5.) How can an individual become a write-in candidate? (§163-123)

* An individual seeking to become a write-in candidate for President must file with the SBE a declaration of intent (containing the following: name, residential address, declaration of intent, office sought, date of election, date of declaration, signature) and petition containing the signatures of 500 qualified voters of the State by noon on the 90th day before the general election – Monday, August 4, 2008. Verification by the chairman of the CBE shall be completed within two weeks from the date the petitions are presented.

6.) What are the Campaign Reporting requirements? (§163-278.30)

* If you plan to be a 2008 candidate for a federal office you or your campaign treasurer, need to contact the Federal Election Commission for filing requirements. Toll Free Number 1-800-424-9530
* As a candidate for federal office, you are responsible to the Federal Election Campaign Act of 1971, P.L. 92-225, as amended (T.2, U.S.C. Section 439).


Sounds like we'd ought to have a petition going around ASAP!!!!!! Just in case, of course.

NC goes with the popular person. If the chair of the NC Rep party is told to leave Dr. Paul off the ballot, he/she will do so.

10 more to be held today in Maine. This isn't over by a long shot.

Games are being played by Romney in Maine and we are still pulling in the delegates. That is what counts. Dr. Paul is moving up and how NC could say this is not national news is pure BS.

and they have a poll on the home page, asking who you think will be the GOP nominee. Unfortunately the County Party Chairman is a Mormon Romney supporter, so you can guess what kind of chance WE have.

In my opinion, I don’t think that Linda Daves could possibly be so foolish – I want to say stupid – as to exclude Ron Paul from the ballot. It would really be the end of the Republican Party as we know it (That may be a good thing!!). They would not have to deal with the “Ron Paul Revolution”, they would be dealing with a Rebellion!!



However, it will be necessary to find out on Feb. 5 what names she has certified to be placed on the ballot.



Many people are already realizing how the Establishment Media has tried to shut him out of the political process. Denial of ballot access would be such a blatant injustice it would work to our advantage. Therefore, I don’t think they will try it.



No one, to my knowledge, is organizing a petition drive, but with the number of Ron Paul supporters, 10,000 signatures would not be too difficult.

So here's how I see it--

We can wait & see if Ms. Dawes feels inclined to include Dr. Paul on the ballot..... or we can go ahead & start a petition in the hopes of having someone in Raleigh file it by Tuesday. I don't know how to get one going, but if someone can lead me through it, I'll certainly do it!!!

The thing that bothers me, EPF, is that any petition needs to be filed by 1700 tomorrow.

If we wait to see what Ms. Dawes decides, it very well might be too late. My faith in God is great, my faith in Ms. Dawes is nil.

I have an icky feeling about this, that's all. And I've learned to trust my icky feelings.

I missed the 2-19 date somehow. Still we need to be on top of this & not wait around to see if Ms. Dawes will include Dr. Paul or not, imho.

I don't think it would hurt to have 10,000 sigs at the ready.

Okay That gives us 2 weeks to get 10,000 signatures if they chose to leave him off the ballot. That should not be a problem to get this. A quick e-mail with a link to an online petition sent out by HQ would accomplish this.

Any person seeking the endorsement by the national political party for the office of President of the United States, or any group organized in this State on behalf of, and with the consent of, such person, may file with the State Board of Elections petitions signed by 10,000 persons who, at the time they signed are registered and qualified voters in this State and are affiliated, by such registration, with the same political party as the candidate for whom the petitions are filed. Such petitions shall be presented to the county board of elections 10 days before the filing deadline and shall be certified promptly by the chairman of the board of elections of the county in which the signatures were obtained and shall be filed by the petitioners with the State Board of Elections no later than 5:00 P.M. on the Monday prior to the date the State Board of Elections is required to meet as directed by G.S. 163‑213.4.
The petitions must state the name of the candidate for nomination, along with a letter of approval signed by such candidate. Said petitions must also state the name and address of the chairman of any such group organized to circulate petitions authorized under this section. The requirement for signers of such petitions shall be the same as now required under provisions of G.S. 163‑96(b)(1) and (2). The requirement of the respective chairmen of county boards of elections shall be the same as now required under the provisions of G.S. 163‑96 as they relate to the chairman of the county board of elections.
The State Board of Elections shall forthwith determine the sufficiency of petitions filed with it and shall immediately communicate its determination to the chairman of such group organized to circulate petitions. § 163‑123. Declaration of intent and petitions for write‑in candidates in partisan elections.
(a) Procedure for Qualifying as a Write‑In Candidate. – Any qualified voter who seeks to have write‑in votes for him counted in a general election shall file a declaration of intent in accordance with subsection (b) of this section and petition(s) in accordance with subsection (c) of this section.
(b) Declaration of Intent. – The applicant for write‑in candidacy shall file his declaration of intent at the same time and with the same board of elections as his petition, as set out in subsection (c) of this section. The declaration shall contain:
(1) Applicant's name,
(2) Applicant's residential address,
(3) Declaration of applicant's intent to be a write‑in candidate,
(4) Title of the office sought,
(5) Date of the election,
(6) Date of the declaration,
(7) Applicant's signature.
(c) Petitions for Write‑in Candidacy. – An applicant for write‑in candidacy shall:
(1) If the office is a statewide office, file written petitions with the State Board of Elections supporting his candidacy for a specified office. These petitions shall be filed on or before noon on the 90th day before the general election. They shall be signed by 500 qualified voters of the State. No later than 5:00 p.m. on the fifteenth day preceding the date the petitions are due to be filed with the State Board of Elections, each petition shall be presented to the board of elections of the county in which the signatures were obtained. A petition presented to a county board of elections shall contain only names of voters registered in that county. Provided the petitions are timely submitted, the chairman of the county board of elections shall examine the names on the petition and place a check mark by the name of each signer who is qualified and registered to vote in his county. The chairman of the county board shall attach to the petition his signed certificate. On his certificate the chairman shall state that the signatures on the petition have been checked against the registration records and shall indicate the number of signers who are qualified and registered to vote in his county and eligible to vote for that office. The chairman shall return each petition, together with the certificate required in this section, to the person who presented it to him for checking. The chairman of the county board shall complete the verification within two weeks from the date the petition is presented.
(2) If the office is a district office comprising all or part of two or more counties, file written petitions with the State Board of Elections supporting his candidacy for a specified office. These petitions must be filed with the State Board of Elections on or before noon on the 90th day before the general election and must be signed by 250 qualified voters. Before being filed with the State Board of Elections, each petition shall be presented to the board of elections of the county in which the signatures were obtained. A petition presented to a county board of elections shall contain only names of voters registered in that county who are eligible to vote for that office. The chairman of the county board shall examine the names on the petition and the procedure for certification shall be the same as specified in subdivision (1).
(3) If the office is a county office, or is a school administrative unit office elected on a partisan basis, or is a legislative district consisting of a single county or a portion of a county, file written petitions with the county board of elections supporting his candidacy for a specified office. A petition presented to a county board of elections shall contain only names of voters registered in that county. These petitions must be filed on or before noon on the 90th day before the general election and must be signed by 100 qualified voters who are eligible to vote for the office, unless fewer than 5,000 persons are eligible to vote for the office as shown by the most recent records of the appropriate board of elections. If fewer than 5,000 persons are eligible to vote for the office, an applicant's petition must be signed by not less than one percent (1%) of those registered voters. Before being filed with the county board of elections, each petition shall be presented to the county board of elections for examination. The chairman of the county board of elections shall examine the names on the petition and the procedure for certification shall be the same as specified in subdivision (1).
(d) Form of Petition. – Petitions requesting the qualification of a write‑in candidate in a general election shall contain on the heading of each page of the petition in bold print or in capital letters the words: "THE UNDERSIGNED REGISTERED VOTERS IN __________ COUNTY HEREBY PETITION ON BEHALF OF AS A WRITE‑IN CANDIDATE IN THE NEXT GENERAL ELECTION. THE UNDERSIGNED HEREBY PETITION THAT SUBJECT CANDIDATE BE PLACED ON THE LIST OF QUALIFIED WRITE‑IN CANDIDATES WHOSE VOTES ARE TO BE COUNTED AND RECORDED IN ACCORDANCE WITH G.S. 163‑123."
(e) Defeated Primary Candidate. – No person whose name appeared on the ballot in a primary election preliminary to the general election shall be eligible to have votes counted for him as a write‑in candidate for the same office in that year.
(f) Counting and Recording of Votes. – If a qualified voter has complied with the provisions of subsections (a), (b), and (c) and is not excluded by subsection (e), the board of elections with which petition has been filed shall count votes for him according to the procedures set out in G.S. 163‑182.1, and the appropriate board of elections shall record those votes on the official abstract. Write‑in votes for names other than those of qualified write‑in candidates shall not be counted for any purpose and shall not be recorded on the abstract.
(f1) When any person files a petition with a board of elections under this section, the board of elections shall, immediately upon receipt of the petition, inspect the registration records of the county and cancel the petition of any person who does not meet the constitutional or statutory qualifications for the office, including residency.
The board shall give notice of cancellation to any person whose petition has been cancelled under this subsection by mail or by having the notice served on that person by the sheriff. A person whose petition has been cancelled or another candidate for the same office affected by a substantiation under this subsection may request a hearing on the issue of constitutional or statutory qualifications for the office. If the person requests a hearing, the hearing shall be conducted in accordance with Article 11B of Chapter 163 of the General Statutes.
(g) Municipal and Nonpartisan Elections Excluded. – This section does not apply to municipal elections conducted under Subchapter IX of Chapter 163 of the General Statutes, and does not apply to nonpartisan elections except for elections under Article 25 of this Chapter. I was told that candidates have until 2/11 to register. The secretary referred me to Brent Woodcox, Communications Director. I shot him an email at wilcox@ncgop.org stating the importance of including all candidates, including Huckabee and Ron Paul as to get every NC republican involved. I felt it better to include "that other guy" as well since my experience in only mentioning Ron Paul hasn't been as well received.

Also sent a few emails to folks on NCGOP website last night.

This part here needs some clarifying, imho (dumbing down fer the hillbilly, if you will):


(c) Petitions for Write‑in Candidacy. – An applicant for write‑in candidacy shall:
(1) If the office is a statewide office, file written petitions with the State Board of Elections supporting his candidacy for a specified office. These petitions shall be filed on or before noon on the 90th day before the general election. (It reads before the GE, not the primaries--am I understanding this correctly? Because it also specifys a 'statewide office')They shall be signed by 500 qualified voters of the State. No later than 5:00 p.m. on the fifteenth day preceding the date the petitions are due to be filed with the State Board of Elections, each petition shall be presented to the board of elections of the county in which the signatures were obtained. [So does Ron Paul need someone to file individually in each 100 counties, if he has to file as a write in candidate?] A petition presented to a county board of elections shall contain only names of voters registered in that county. Provided the petitions are timely submitted, the chairman of the county board of elections shall examine the names on the petition and place a check mark by the name of each signer who is qualified and registered to vote in his county. The chairman of the county board shall attach to the petition his signed certificate. On his certificate the chairman shall state that the signatures on the petition have been checked against the registration records and shall indicate the number of signers who are qualified and registered to vote in his county and eligible to vote for that office. The chairman shall return each petition, together with the certificate required in this section, to the person who presented it to him for checking. The chairman of the county board shall complete the verification within two weeks from the date the petition is presented.
(2) If the office is a district office comprising all or part of two or more counties, file written petitions with the State Board of Elections supporting his candidacy for a specified office. These petitions must be filed with the State Board of Elections on or before noon on the 90th day before the general election and must be signed by 250 qualified voters. Before being filed with the State Board of Elections, each petition shall be presented to the board of elections of the county in which the signatures were obtained. A petition presented to a county board of elections shall contain only names of voters registered in that county who are eligible to vote for that office. The chairman of the county board shall examine the names on the petition and the procedure for certification shall be the same as specified in subdivision (1).
(3) If the office is a county office, or is a school administrative unit office elected on a partisan basis, or is a legislative district consisting of a single county or a portion of a county, file written petitions with the county board of elections supporting his candidacy for a specified office. A petition presented to a county board of elections shall contain only names of voters registered in that county. These petitions must be filed on or before noon on the 90th day before the general election and must be signed by 100 qualified voters who are eligible to vote for the office, unless fewer than 5,000 persons are eligible to vote for the office as shown by the most recent records of the appropriate board of elections. If fewer than 5,000 persons are eligible to vote for the office, an applicant's petition must be signed by not less than one percent (1%) of those registered voters. Before being filed with the county board of elections, each petition shall be presented to the county board of elections for examination. The chairman of the county board of elections shall examine the names on the petition and the procedure for certification shall be the same as specified in subdivision (1).
(d) Form of Petition. – Petitions requesting the qualification of a write‑in candidate in a general election shall contain on the heading of each page of the petition in bold print or in capital letters the words: "THE UNDERSIGNED REGISTERED VOTERS IN __________ COUNTY HEREBY PETITION ON BEHALF OF AS A WRITE‑IN CANDIDATE IN THE NEXT GENERAL ELECTION. THE UNDERSIGNED HEREBY PETITION THAT SUBJECT CANDIDATE BE PLACED ON THE LIST OF QUALIFIED WRITE‑IN CANDIDATES WHOSE VOTES ARE TO BE COUNTED AND RECORDED IN ACCORDANCE WITH G.S. 163‑123."
(e) Defeated Primary Candidate. – No person whose name appeared on the ballot in a primary election preliminary to the general election shall be eligible to have votes counted for him as a write‑in candidate for the same office in that year.[And what the heck is this? Will write -in votes not count for Ron Paul unless we file the appropriate petitions before the GE? I really just want to understand this, that's all.]
(f) Counting and Recording of Votes. – If a qualified voter has complied with the provisions of subsections (a), (b), and (c) and is not excluded by subsection (e), the board of elections with which petition has been filed shall count votes for him according to the procedures set out in G.S. 163‑182.1, and the appropriate board of elections shall record those votes on the official abstract. Write‑in votes for names other than those of qualified write‑in candidates shall not be counted for any purpose and shall not be recorded on the abstract.
(f1) When any person files a petition with a board of elections under this section, the board of elections shall, immediately upon receipt of the petition, inspect the registration records of the county and cancel the petition of any person who does not meet the constitutional or statutory qualifications for the office, including residency.
The board shall give notice of cancellation to any person whose petition has been cancelled under this subsection by mail or by having the notice served on that person by the sheriff. A person whose petition has been cancelled or another candidate for the same office affected by a substantiation under this subsection may request a hearing on the issue of constitutional or statutory qualifications for the office. If the person requests a hearing, the hearing shall be conducted in accordance with Article 11B of Chapter 163 of the General Statutes.
(g) Municipal and Nonpartisan Elections Excluded. – This section does not apply to municipal elections conducted under Subchapter IX of Chapter 163 of the General Statutes, and does not apply to nonpartisan elections except for elections under Article 25 of this Chapter. (1987, c. 393, ss. 1; 2; 1989, c. 92, s. 1; 1999‑424, s. 5(c); 2001‑319, s. 9(a); 2001‑398, s. 7; 2001‑403, s. 12; 2002‑158, s. 13; 2004‑127, s. 7; 2006‑155, s. 4.)

So from what I am understanding, the above section (with my Q's in red) is only applicable if RP does not win our primary & we want to have our written-in vote count in the general election. Please correct me if I'm wrong here.

What we need to be keeping our eyes on right now is Ms. Dawes and this first section:

§ 163-214.4. Nomination by the State Board of Elections

By the first Tuesday in February of the year preceding the North Carolina presidential preference primary, the chair of each political party shall submit to the State Board of Elections a list of its presidential candidates to be placed on presidential preference primary ballot. The list must be compromised of candidates whose candidacy is generally advocated and recognized in the news media throughout the United States or in North Carolina, unless any such candidate executes and files with the chair of the political party an affidavit stating without qualification that the candidate is not and does not intend to become a candidate for nomination in the North Carolina Presidential Preference Primary Election.
The State Board of Elections shall prepare and publish a list of the names of the presidential candidates submitted.

* On the first Tuesday in March preceding the presidential preference primary (March 4, 2008) the State Board of Elections (SBE) will convene in Raleigh to nominate all candidates affiliated with a recognized political party pursuant to the provisions of Article 9 of Chapter 163 of the General Statutes, who have been submitted to the State Board of Elections. Immediately upon completion of these requirements, the board shall release to the news media all such nominees selected. Provided, however, nothing shall prohibit the partial selection of nominees prior to the meeting required by this section, if all provisions herein have been complied with.
* - or- Nomination by Petition -Any person seeking the endorsement by a national political party, may file with the SBE petitions signed by 10,000 qualified voters who are affiliated with the same political party as the candidate for whom the petitions are filed. Petitions must be filed with the county board of elections (CBE) by February 19, 2008, which is ten days before the filing deadline. The signatures on the petitions must be verified by the appropriate CBE and filed at the SBE by the candidate no later than 5:00 PM on the Monday prior to the date the SBE is required to meet pursuant to GS 163-213.4 preceding the presidential preference primary

Hillbilly, your guess is as good as mine. I posted this as soon as I found it and am still sorting through this myself.

As far as I'm concerned I'm passing out petitions at my meet-up tonight. I'm sorry if I offend any neo-cons, but damnit Ron Paul WILL be on that ballot. I have seen too many Republican parties in too many states marginalize and try to nullify him.

But if we are to petition for Ron Paul, we have to have that done from how I understood the boe rules.

I agree Mr. Facto. NH, ME, LA...... all states where we expected Ron Paul to do far better than the numbers they fed us.


We need to plan for the unexpected at every turn here. We need not grow complacent & assume that the boe or the ncgop is going to play fair. We need to be prepared. We also need to let them know we are watching them.

I hate to sound like that, but dangit---they set the rules & if we want to play we need to know those rules thoroughly & use them to our advantage, IMHO. Ignorance of those rules will not serve us well. Neither will complacency.

We need to be sure that everyone knows when we canvass that there are two candidates running. Ron Paul and Hillary Clinton. :)
